In his annual report to the Assembly, Prosecutor General Olsian Çela highlighted the concern of prison overcrowding. Despite the recommendations, Çela said, there is no reflection from prosecutors.

At the joint meeting of the Committee on Civic Initiatives, Cooperation and Institutional Oversight and that of Legal Affairs and Public Administration, the Prosecutor General, Olsian Çela, is reporting on the activity of the institution he leads in 2024. Çela said that during 2024 they treated a total of 61,176, an increase of more than 10% compared to 2023.

"In 2024, the Prosecution Office handled 61,176 materials under review, an increase of 10.52% compared to the previous year. 47,576 criminal proceedings were pursued, an increase of 4.79% compared to 2023. Of which, 24,956 criminal proceedings were registered, 22,441 were carried over proceedings and 179 were resumed. The largest number of registered criminal proceedings is in Tirana, 35.5% of the total, while the lowest is in Dibër and Kukës, around 2.5%," he said.

In his annual report to the Assembly, Prosecutor General Olsian Çela highlighted the concern of prison overcrowding. Despite the recommendations, Çela said, there is no reflection from prosecutors, who continue with extreme prison measures and not the use of pre-trial detention measures. According to him, 80% of security measures are prison arrest during 2024, an increase from the previous year.

"13,062 requests for personal security have been filed with the court. Data on prosecutors' requests for security measures show that in 2024, a coercive security measure was requested for about 60% of defendants or 34% of persons under investigation.

It turns out that 59.5% of requests are related to the imposition of a measure of arrest, requested for about 36% of registered defendants or 20% of persons under investigation in total. In 2023, a coercive security measure was requested for over 55% of registered defendants or 32% of persons under investigation. About 59.3% of requests are related to the imposition of a measure of arrest, requested for 32.8% of defendants or 19% of those under investigation.

In only 31 cases in total was the measure of financial guarantee requested. Meanwhile, prison arrest was requested against 3,078 people, and mandatory reporting was requested against 2,611 people. There is a tendency for the use of more extreme measures by prosecutors and courts. Based on this data, an instruction on security measures was approved in July 2024. However, despite this instruction, there is still no reflection on the part of prosecutors," said Çela.

Çela has addressed the urgent request for improving the infrastructure of justice institutions. Çela has announced that a special request has been addressed to the Ministry of Justice, but the issue of the land that will be used for construction as well as the financing for the project remains to be decided.

He also criticized the Criminal Code, saying that it was not an emergency. According to him, the arguments that it is old and needs to be adapted for European integration do not hold up because, firstly, there are old codes that work best and, secondly, they have interacted very well with internationals with the current code.
