The High Judicial Council has decided to increase the reference salary for judges in Albania by 65,600 lekë.

The decision was approved on Wednesday with 9 votes in favor and none against.

According to the Supreme Court, the increase will be implemented from August 1, 2026.

With the new change, the reference salary of judges goes to 222,425 lek, from 156,800 lek previously. To this amount is added a qualification level allowance of 14,000 lek.

The Supreme Court has also approved the proposal for compensation for the salary increase that, according to it, is missing for the period from April 1, 2023 to July 31, 2026.

The Democratic Party has also reacted to the decision. The head of the DP Parliamentary Group, Gazment Bardhi, described the situation as a serious institutional impasse.

Bardhi accuses the government and the majority of having consistently refused to implement the decisions of the Constitutional Court, saying that this endangers the democratic functioning of the state and the principle of separation of powers.

Bardhi's full reaction:

The continued refusal of the Government and the majority in the Albanian Parliament to implement the decisions of the Constitutional Court has seriously jeopardized the democratic functioning of the state and respect for the principle of separation and balance of powers.

Since August 1, 2026, the judicial system in the country has been left without a clear legal basis to justify the financial treatment of judges and prosecutors of the Republic. The relevant legal provisions have been repealed by the Constitutional Court with effect from July 31, 2026.

Today, in an unprecedented act, the judicial system, through the High Judicial Council, has determined its own salary, assuming powers that belong to the legislator. This act raises serious questions about its constitutionality and the existence of a legal basis for a decision of this nature.

The creation of this institutional deadlock and the clash between the constitutional powers of the powers not only can, but must be avoided. The only way to resolve this situation is the full, immediate and unequivocal respect and implementation of the binding decisions of the Constitutional Court.

The Albanian Parliament must act immediately and without delay to address and resolve this issue. This is even more necessary in light of the refusal of the Council of Ministers to fulfill the responsibility set forth by the Legislative Council of the Albanian Parliament on May 4, 2026.

The inaction of the Assembly and the failure to implement the decisions of the Constitutional Court constitute a serious violation of constitutional principles and the rule of law, with serious consequences for the functioning of institutions and citizens' trust in democracy. This attitude also seriously undermines the spirit of constitutional loyalty that should guide the relations between powers in a democratic society.

There can be no rule of law when the decisions of the Constitutional Court are chosen to be implemented according to political interest. The decisions of the Constitutional Court are not recommendations nor are they options to be implemented when it suits the majority. They are binding. Respecting them is a constitutional obligation, not a political choice.
