Today, the next court session on the "Gërdeci" case was held, while former Minister of Defense, Fatmir Mediu, was also present in the courtroom.
He stated that six American congressmen have requested that the testimonies of military and political figures of the time provided by the United States of America be taken into account in the process.
"Six American congressmen have sent a letter to the Albanian Ministry of Justice, requesting that the testimonies of military and political figures of the time, voluntarily given in the US in the form of "affidavits" (declarations under oath that have the value of evidence in the American justice system), be taken into account in the "Gërdeci" process," Mediu said during the session.
His action comes after the Court Against Corruption and Organized Crime rejected their summons as witnesses.
The media, after leaving the GJKKO premises, gave a press statement regarding what was discussed within the special court.
"First, regarding the judicial debate. I made it clear that it is against the law for the Minister of Defense, who is a civil authority, to be required to recognize calibers. Furthermore, I emphasize another thing, that there is no legal act that measures large and small calibers, there is a practice already established in the Ministry of Defense, in cooperation with international companies and NATO partners, where calibers 20-160 mm are considered small calibers ," he said.
The former minister stated that special experts have stated that there are no acts that determine the minister's responsibility for the transport of calibers.
"Furthermore, what has to do with the transportation of ammunition. Telling the minister that you must determine by order, that the order of the previous minister... When a ministerial order is issued, it has an implementing structure. Quite simply, I think that the minister is responsible in front of the Constitution, international agreements, laws and government decisions. The acts that have been issued by the minister have determined the mandatory reporting structures, especially in the case of the Ministry of Defense. This is in terms of debates. But, I must say that clearly, both military experts and experts dealing with transportation have said that there are no acts that determine the minister's responsibilities regarding the transportation of calibers. These are matters of regulations ," he said.
Likewise, he also stopped at his request for witnesses.
"We have requested that our list of witnesses include those who have assisted us, who are senior, honored military officers of the United States of America. The Supreme Commander of NATO, there have also been two American teams who have assisted us in the preparation of all legal acts regarding defense policies ," he said.
SPAK accuses Mediu of abusing his office by issuing several bylaws that brought advantages to private companies that would carry out the dismantling.
Former Defense Minister Fatmir Mediu, the defendant in this case, has denied all charges and previously stated that the prosecution's claim is unfounded.
The next hearing for Mediu will be held on June 24, at 1:00 PM.
