Leonard Duka's trial, GJKKO rejects the request to summon police officers
Santiago Malko and Leonard Duka

The Special Court held the next hearing today for the defendant Leonard Duka, accused of being the leader of the group called "Duka Clan" and the organizer of the murder of former police officer Santiago Malko, in August 2019 in the "Porcelani" area of Tirana.

Leonard Duka's lawyer requested that police officers, as well as the much-wanted Ervis Martinaj, testify at the hearing, but the latter's fate is unknown.

Leonard Duka's lawyer: Blendi Teta gave statements before the court and provided new details important for this trial. First, during Blendi Teta's questioning, the prosecutor took him to another session, telling him not to make a statement. This is in violation of the law. Who were the police officers who accompanied Blendi Teta to the GJKKO halls? The prosecutor asked him not to make statements in front of the black squads. We ask that the officers be called and declare who asked Blendi Teta to accompany them to another hall? We ask the court to verify Blendi Teta's statements. Regarding the new evidence presented by the prosecution, they came in the form of an email from the French authorities, not as a document. Regarding the SKY ECC codes, we ask to know whether the Sky ECC code that Leonard Duka allegedly used was used by only one person or several? We request that Erlis Duka, Leonard Duka, Ervis Martinaj, etc. be questioned about whether they are Sky ECC users or whether they stand by the evidence brought by the prosecution. An expert should also be called and verify whether the user is Leonard Duka or not. We request that Muhamed Duka, Leonard Duka's father, be called to give statements regarding the alleged incident.

Prosecutor Behar Dibra: I find the requests unfounded and unsupported in terms of this trial. Regarding the lawyer's claim about my contact with Blendi Tetës, it is true that I have contacted him. There is no legal obstacle here. Next, the method of identification of the Sky ecc application is that of the judicial police, there is no other way. Regarding the summoning of persons to give testimony, the fate of Ervis Martinaj, his location, and more, is not yet known. Some of those requested by the lawyer are part of this trial. Leonard Duka can definitely testify. The others are unfounded.

While the Special Court ruled to dismiss the request to summon police officers in this process. The Court finds that it was explained in the courtroom by the defendant and the prosecutor who met.

"It is unnecessary for this process to verify Blendi Tetë's statements."

Regarding the letters of request for Sky ECC, the court finds that the acts were obtained within the framework of another proceeding. Letters of request were made within the framework of two proceedings.

"For the summoning of wanted persons as witnesses, the court says that the moment there is a notification from the police about their arrest, then they can appear to testify. For Ervis Martinaj etc., there is no data on their whereabouts ," argued the GJKKO.

Meanwhile, for Muhamet Duka, the court accepts the defense's request to appear as a witness.

The next session will take place on June 25th at 10:00 AM.
