The Special Court has rejected the request of the defense lawyers of the missing Ervis Martinaj and his other family members who requested the lifting of the seizure and the release of the properties.

According to legal defense attorneys, this request has been submitted to the Court for about two years, while legal deadlines specify a review period of one year.

After Judge Erion Bani withdrew his decision, he decided: To dismiss the request.

According to him: "The request to terminate the security measure is unfounded in law and evidence, while the prosecution has the authority to investigate for two years from the seizure, based on the law, there are several requests to extend the seizure and it has been decided to extend the seizure period twice until December 2025.

According to Ban: The measure expires if, at the moment the extended period of the measure expires, confiscation has not been requested by the prosecution.

The Court considers that the Prosecution has filed the request for confiscation within the legal deadline and therefore we are not in the conditions for termination. In conclusion, the request for termination of the seizure measure of Martinaj's assets is dismissed."

In 2023, by decision of the Special Court, 34 assets were seized from Ervis Martinaj and his family members and persons associated with him.

Meanwhile, in the next session, at the request of SPAK, a group of people who own Ervis Martinaj's properties, including his father Mustaf Martinaj, are expected to be questioned as witnesses.
