Lawyer Dorian Matilja has reacted to the arrest of several dozen protesters, following yesterday's clash in front of Parliament.
He asks the Prosecution to see the videos of what the Police did.
"CALL FOR THE TIRANA PROSECUTOR'S OFFICE"
At this time, the Tirana Prosecutor's Office has the arrests of the protesters in hand and is probably analyzing the footage. It is clear from them what the police themselves have done. We, the lawyers who are dealing with these issues, as well as every citizen, are seeing them clearly.
When a citizen is lying on the ground, neutralized, or is fleeing, hitting him with a rubber baton, kicking him, dragging him, throwing tear gas or using bear spray are not in the name of maintaining order. They are crimes that should be criminally investigated.
Article 3 of the European Convention on Human Rights prohibits all inhuman and degrading treatment. This is the only article of the convention that has no exceptions or justifications. It cannot be justified by public order, emergency, violence by protesters, or any other state interest.
Therefore, the Prosecution, which is now reviewing the videos to hold protesters accountable, cannot remain unnoticeable in the face of criminal police violence.
If protesting citizens are to be investigated individually, state violence must also be investigated, for every police officer and every order-givers.
At this delicate moment, I call on the Tirana District Prosecutor's Office to consider the following:
1. Protesting is not a crime, with or without permission. The Constitutional Court has given its verdict on this matter.
2. Throwing eggs at objects, sitting in the square, peaceful blockades, chants, banners or civic revolt are not crimes.
3. Beating citizens, dragging them, humiliating them are crimes, by their superiors and subordinates.
"Here, the task of the Prosecutor's Office is of primary importance to maintain order. Because if the criminal liability of those in uniform, which stems from the same evidence that you are collecting for the citizens, is not addressed, many others tomorrow will rightly be encouraged to resolve this matter themselves, even by taking individual criminal responsibility if necessary," he says.
