Jonaid Myzyri

A dubious mechanism set up within the Centralized Purchasing Operator by Jonaid Myzyri is massively fining Albanians, not only by blocking tenders, but also by declaring the most expensive bids the winners.

According to official documents, the scheme is carried out through a deliberate clash between two offices within the Operator itself. These are the Bid Evaluation Commissions as the first instance and the Complaints Review Commissions as the second instance of decision-making for procurement procedures.

The most recent case is the 1.16 billion lek or 12.6 million euro tender for the construction of the Korça hospital.

Korca Hospital

The tender for the construction of the Korça hospital was held by the OBP on July 13 of this year and 7 offers were submitted. According to official documents, the lowest offer was that of the Dion-Al and Ergi consortium, which offered a price of about 777 million lek or 8.4 million euros for the construction of the Korça Hospital.

Three weeks after the competition, the Bid Evaluation Committee at the Public Procurement Office decided to declare this bid the winner and the preliminary decision to declare the winner was also published at the Public Procurement Agency.

But the game changed later. After the winner was announced, the tender was appealed by the joint venture of the companies Fusha and Rej to the Complaints Review Commission, also within the OBP.

These two companies had given the third most favorable offer in the competition worth 912.7 million lek or 10 million euros.

After a long review, the day before, the OBP's KSHA made the decision to change the winner of the tender by disqualifying the bids of the winning companies Dion-Al and Ergi and declaring Fusha me Rej the winner, even though they had a price 1.4 million euros higher than the winners.

Once a coincidence, two clues prove it

This is not the first time that the Centralized Purchasing Operator has implemented this mechanism. The same identical scheme was also implemented for the reconstruction of the Mati Hospital, but this time through a more sophisticated maneuver. This tender, with a limit value of 3.7 million euros, was held on July 21.

9 bids participated in it, the lowest of which was the merger of the companies Ec Pro Partners, Gjikuria and Dion-Al, worth 224 million lek. Once again, the Bid Evaluation Commission at the Public Procurement Office declared the lowest bid the winner by publishing the decision in the APP.

But again, the same mechanism was put into place. The company that had the fourth cheapest bid appealed to the OBP Complaints Review Commission for unfair disqualification.

The KSHA qualified the bid declared the winner by the KVO automatically as abnormally low.

Both of these decisions bring the fine to 2 million euros within a week, which Jonaid Myzyri and his accomplice, Erjon Gjyshi, imposed on Albanian citizens.

But why?

War within the OBP

Jonaid Myzyri was appointed head of the Centralized Purchasing Operator on June 18. Previously, this institution was headed for a relatively long time by Arlinda Pogaj, who had installed her own people in the institution. Since the KVOs of the tenders in question were appointed by Pogaj, the best way to catch them was at the appeal stage, i.e. in the Complaints Review Commission.

To do this, Jonaid Myzyri took his friend Erjon Gjyshi from the KPP with him.

Grandpa is now the man who dictates the decisions of the KSHA, although officially he has the position of coordinator.

An internal war has broken out between the Grandfather and the current Director of Appeals, with the latter disagreeing with the overturning of the winners of the high bids and refusing to sign these decisions. This is the reason why the tender results are not announced publicly.

The entire collapse in the OBP is a consequence of this sophisticated scheme. Now the vast majority of the procurement procedures of the largest contracting institution in the country are blocked either in the KVO-KSHA network or in the Public Procurement Commission.

What is happening is unprecedented, taking hostage the most important sectors of the country, including healthcare, where no procurement procedure is closed, solely as a result of the great struggle to capture tenders./ Kapitali
