The Albanian government has approved the creation of a special electronic registry for persons referred or under investigation for violent actions during the protests, giving the State Police a new instrument for identifying, monitoring and exchanging information on them.

The decision of the Council of Ministers, approved on October 28, also provides for the possibility for the Border Police to administratively refuse the exit from the country of persons included in the register, even when a security measure prohibiting their departure from Albania has not been imposed on them.

The measure comes during a period of tensions related to the protests that have been taking place since October 13 and on the same day that the Anti-Terrorism Directorate announced the arrest of one person and the referral to the prosecutor's office of 17 others for suspected criminal offenses in the context of the rallies.

The new registry will be administered by the General Directorate of the State Police and will include persons identified in the materials referred to the prosecution, for whom concrete violent actions against life, health or public and private property are documented during gatherings and demonstrations.

This means that inclusion in the registry is not conditional on a court verdict of guilt, but can be based on documentation referred by the police.

Border restrictions even without a court decision

One of the most important provisions of the decision relates to the competencies of the Border and Migration Police.

According to the act, when individual verification reveals concrete data about a person's participation in violent actions during public demonstrations, the Border Police may administratively refuse his exit from Albanian territory, based on the law on state border control.

This possibility is expressly provided for even in cases where there is no judicial measure prohibiting departure abroad.

The decision also stipulates that, if the person is not refused exit, the border authorities shall notify the authorities of the country of destination of the fact that he has been referred for the criminal offenses specified in the act.

Another provision stipulates that the General Directorate of the State Police shall notify private natural and legal persons who administer accommodation structures for individuals against whom there is concrete evidence of participation in violent acts and materials have been referred to the prosecutor's office.

These definitions expand the use of police information beyond criminal investigation, linking it to the control of international movement and communication with private entities.

Non-criminal registration and data protection

The register will contain data on the identity of persons, the source of information, the date of registration, procedural references, restrictive measures in force and the history of updates.

The information will be provided through interaction with the National Civil Status Registry and the electronic systems of the State Police.

The decision specifies that data exchange does not create general police access to prosecutorial records.

For referred persons, the need for data retention must be reviewed within 30 days of registration. If the prosecution decides not to initiate criminal proceedings or to dismiss the case, the person's data is deleted from the register.

The government provides that the processing of information be carried out in accordance with the legislation on the protection of personal data, guaranteeing confidentiality, access limitation and proportionality.

However, the mechanism raises legal questions about the relationship between administrative measures and the presumption of innocence, especially when data on a person who has not been found guilty can be used to restrict movement or communicated to third parties.

Another issue is how the proportionality of the refusal to leave the country will be controlled and what procedural guarantees will be available to persons affected by administrative decision-making.
