The hearing at the Constitutional Court to declare the end of Judge Holta Zaçaj's mandate has been postponed to Tuesday at 1:00 PM.
The Constitutional Court says that the Supreme Court's acts will be communicated to Zaçaj, so that the latter can provide a written opinion.
"The Constitutional Court met today, on 16.12.2024, at 11:00, to consider the request of the President of the Constitutional Court for the declaration of the end of the mandate of Judge Holta Zaçaj. The Court administered the documentary practice of the High Court, which accompanied the procedure for filling the vacancy and the election of Ms. Holta Zaçaj as a member of the Constitutional Court, as well as the notification of the President of that court for the opening of the procedure for the election of a new member of the Constitutional Court, which, based on the request of the Court, were officially sent by the High Court on Friday, 13.12.2024, at 16:30. The Court considered that the acts in question should be communicated to Judge Holta Zaçaj, at the same time the President of the Court, who has set this process in motion, with the aim of getting to know her and assessing the submission of a written opinion regarding them. For these reasons, the Court decided to postpone the session to tomorrow, 17.12.2024, at 13:00 ,” the Constitutional Court announces.
We recall that Zaçaj gave an exhaustive explanation a few days ago regarding the end of her mandate and emphasized that the Supreme Court cannot declare the position vacant without a decision of the Constitutional Court.
