Does the new draft law "free" ministers from signatures, reform or to

Ministers are expected to be relieved of the burden of firms and direct responsibility, as decision-making will be delegated to the heads of the directorates of various sectors. This is foreseen in a new draft law on the functioning of the state administration, which aims to transform the decision-making mechanism within ministries and subordinate institutions.

According to the Ministry of State for Public Administration and Anti-Corruption, the goal is to increase the efficiency and quality of work in the administration, through the transfer of responsibility to the middle managerial levels. Except in cases where the law requires otherwise, or when the minister or secretary general expressly decides to bear the responsibility himself, the decisions will be signed by the respective directors.

"The objective is to transfer decision-making to the middle managerial level of the institution, accompanied by increasing responsibility and easing the increased burden on the positions of minister or secretary general. The purpose of the proposal is to improve the overall work of the institutions, increase efficiency, in particular the quality of decision-making, the responsibility for this decision-making, but also the quality of hierarchical control. The officer in charge of the directorate will carry out the preparatory work and propose decision-making, the relevant director will make the decision, approving the proposed decision or take a different decision" - Ministry of State for Public Administration and Anti-Corruption", it is stated in the explanatory report of the ministry.

With this initiative, the officials in charge will prepare the materials, propose solutions, while the director will sign the decision, either by approving the proposal or by amending it.

However, it remains to be seen whether this change will actually bring an improvement in the public administration, or will only serve as a shield for senior officials. Because, although the orders may no longer bear the signature of the ministers, they remain the drafters and political leaders of the policies implemented by the ministries.

And in case of any corrupt affair, it will be the signatory director who will be questioned by the judiciary, not the incumbent who ordered it "orally" or who appointed the director.

Most likely, the draft law came in response to the recent blows of SPAK, which has led to quite a few former government ministers behind bars or on the run. Somehow, a formula had to be found to remove the fear from the handcuffs of those who will continue in the fourth term. /VNA.al
