Sali Berisha reacted from his apartment regarding the decision of the Assembly not to approve the motion for incompatibility of the mandate of MP Olta Xhaçka. The request was made by the opposition deputies, who claim that she cannot continue to be a deputy since her husband has been declared a strategic investor.
"It de facto destroyed the Constitutional Court, without which the Constitution turns into a worthless document. With this act, Edi Rama proved that all powers are concentrated in his hands today. That he no longer controls only "Skapi", the Supreme Court, the Court of Appeal, but also in a rare case, when he is not sure of the decision he wants, he created the Xhafaj Commission to multiply the Constitutional Court by zero", said Berisha.
At the time of voting, 25 democratic deputies voted in favor, while 9 socialists voted against. 65 others pressed the abstention button, causing the draft decision not to receive the necessary votes for approval.
With today's vote, the Assembly, for the second time in a row, refused to implement the decision of the Constitutional Court, which had twice issued a decision underlining that the parliament is obliged to approve the motion of 1/10 of the deputies.
According to the vote, the socialists who voted against are Damian Gjiknuri, Bledar Çuçi, Jyrgis Çyrbja, Anduel Tahiraj, Paulin Sterkaj, Petro Koçi, Shkelqim Bullari, Bujar Çela and Klodiana Spahiu. Olta Xhaçka herself was in the hall during the voting, but did not participate in it.
The Assembly has decided to seek the opinion of the Venice Commission on this issue. "My appeal to the respected Venice Commission is to dismiss with contempt this trap attempt to justify the constitutional coup that Edi Rama and the Xhafaj Commission carried out last night during the Constitutional Court", said Berisha.
