The letter of Spiropal to Venice: Can MPs be forced to vote in a certain way?
Speaker of the Assembly Elisa Spiropali

The Assembly objected for the third time last night to send Olta Xhaçka's mandate to the Constitutional Court.

As stated a day earlier, the Speaker of the Assembly, Elisa Spiropali, addressed the Venice Commission for a final opinion to resolve the impoverliance, on the issue of the mandate of Socialist MP Olta Xhaçka.

Top Channel has provided the letter sent today by the chief of parliament, which seeks clarifications to avoid another clash between the two highest institutions of the Albanian state, the Constitutional Court and the Assembly.

In her letter, Mrs. Spiropali stated that the Constitution obliges the Assembly to implement the decisions of the Constitutional Court, adding that the uncertainty remains how the Assembly should act when there are some constitutional court decisions on issues of the same nature, which are in force and hold antagonistic positions or even more so when the decision compels the mp how he should vote. Through this letter, the Speaker asks:

Is it possible to force the mp to vote in a certain way, viewed in the view of Article 70/1 of the Constitution and Article 73/1 of the Constitution, which provides that the MP is not responsible for the opinions expressed and voted in the Assembly?

Full letter:

Dear Mrs. Claire BAZY MALAURIE,

I take this opportunity to express my gratitude and appreciation to the Albanian Parliament for the valuable contribution of the Venice Commission through relevant opinions on important issues for the consolidation of the rule of law and constitutional institutions in Albania.

On behalf of the Albanian Parliament I am presenting this request for an opinion on the relationship between representative parliamentary democracy and the tax injunctions of the Constitutional Court in the context of the role of the Assembly in considering motions for the incompatibility of the mandate of the Deputy.

The cases of incompatibility in exercising the mandate of the Deputy are provided for in points 2 and 3 of Article 70 of the Constitution of Albania, which expressly states:

"1. Deputies represent the people and are not bound by any binding mandate. 2. Deputies may not simultaneously exercise any other state duty, except that of the member of the Council of Ministers. Other cases of incompatibility are determined by law. 3. Deputies may not carry out any profitable activity derived from the wealth of the state or local government, nor acquire the assets of these. 4. For any violation of paragraph 3 of this article, at the motion of the President of the Assembly or one-tenth of its members, the Assembly decides on sending the matter to the Constitutional Court, which determines incompatibility."

Only the cases provided for in point 3 of Article 70 of the Constitution result in the loss of the mandate of the deputy and for which the Assembly "decides" for sending for the fundamental review of the Constitutional Court, while other cases provided for in point 2 of this article are dealt with by the Assembly according to the legislation in force.

The procedure for reviewing the requests for the incompatibility of the mandate of the Deputy is provided for in point 4 of Article 70 of the Constitution and article 119/1 of the Rules of Assembly. The Regulation of the Assembly is the act that regulates the organization and functioning of the Assembly, as defined in Article 75, point 2, of the Constitution.

The examination of the requirements for the incompatibility of the mandate of the deputy who loses the mandate of the deputy shall be summarized as follows:
i) A body of the Assembly, the Council on Rules, Mandates and Immunities, with equal composition by deputies of the majority and parliamentary minority, shall first examine the requirements (motion) for the incompatibility of the mandate of the Deputy at a first glance (prima facie) if the conditions provided for in point 3 of Article 70 of the Constitution are met. for sending the case to the Constitutional Court according to the provisions of point 4 of Article 70 of the Constitution;
ii) The plenary session of the Assembly decides to send the matter to the Constitutional Court considering the report of the Council. In cases where the Council does not reach agreement, the plenary session shall be presented to the positions of the majority and parliamentary minority in separate reports;
iii) The Constitutional Court examines the basis of the claims in the applications for the incompatibility of the mandate of the Deputy.

In the Constitution of Albania are provided for two ways to set in motion the Constitutional Court for reviewing the requirements for the incompatibility of the mandate of the Deputy:
i) through the Assembly, which is set in motion by request of the President or 1/10 of the Deputies (Article 70, point 4, of the Constitution);
(ii) through the grouping of 1/5 of the Deputies according to Article 134, point 1, letter "c", of the Constitution.

In 2016 the Constitutional Court, with decision no. 7/2016, after making a final interpretation of Article 70 of the Constitution, decided that despite the constitutional provision, 1/5 of the deputies were not directly legitimized to set the Constitutional Court in motion and the Assembly had to send the request/motion for the incompatibility of the mandate of the deputy to the Constitutional Court as soon as it was presented to him. After this decision, the Assembly sent any request/motion to the Constitutional Court.

With two decisions of 2016 (Decision no. 93/2016 and Decision no. 72/2016), taken after decision no. 7/2016, the Constitutional Court decided that the Assembly did not have to send any motion to the Constitutional Court, but only those related to the incompatibility that results in the loss of the mandate of the deputy (cases provided for in point 3 of Article 70 of the Constitution – .... when the deputy himself violates the constitutional prohibition provided for in this provision, i.e. if he performs profitable activities derived from the wealth of the state or local government, or acquires the property of these). The other cases, according to the Constitutional Court, had to examine them on their own.

In 2016 the Constitution of Albania underwent several amendments, but the constitutional provisions, which provide for the right of 1/5 of the deputies to set the Constitutional Court in motion for cases of incompatibility of the mp's mandate, were not changed (Articles 131 and 134 of the Constitution).

In 2016, amendments were made to the law. No. 8577, dated 10.2.2000, "On the organization and functioning of the Constitutional Court", through which a new provision (Article 66) was added, expressly 1/5 of the deputies or the Assembly are defined as subjects that set in motion the Constitutional Court for the incompatibility of the mandate of the deputy.

In 2019 the Assembly adopted amendments to its Rules, wherein among others, it added Article 119/1 to comply with the jurisprudence of the Constitutional Court, provision that provides that the requirements for the incompatibility of the mandate of the Deputy are assessed from a legal-formal point of view at a first glance (prima facie) by the Assembly, without entering the substance if they are according to the criteria of point 3 of Article 70 of the Constitution (i.e. those requests/motions related to the benefit of the deputy directly to public wealth). This is because, according to the constitutional court's decisions (Decision No. 93/2016 and Decision No. 72/2016), the issues related to the criteria of point 2 of Article 70 do not enter the jurisdiction of the Constitutional Court and do not have to be sent to that court for review.

In 2022, two motions were filed in the Albanian Parliament of Albania by different groups of the parliamentary minority (motions submitted by 1/10 of the deputies) on the incompatibility of the mandate of a female mp from the parliamentary majority to the same facts.

These requests were reviewed by the Assembly according to the constitutional jurisprudence and the new legal framework after the constitutional court decision no. 7/2016, and by majority vote decided not to send the case to the Constitutional Court, considering that the criteria of Article 70, point 3, of the Constitution (prima facie assessment) were not met, as it did not result in the mp having received public property or profits from public property.

The grouping of one-five MPs, which was legitimized to address the Constitutional Court directly to seek the incompatibility of the mandate of the Deputy, submitted to this Court the relevant request. One-third of the deputies represented 28 MPs, 15 of whom had submitted to the Assembly one of the motions for the incompatibility of the mandate of the deputy.

The Constitutional Court reviewed this request of one-third of the deputies in the College, at the meeting of judges and in plenary session. It turns out that this request has been considered in the basics. The parties, the applicants and the mp through their representatives/lawyers have submitted the respective claims and claims, the evidence supporting them, answered questions of each other and of the court, exhausted on the basis of the principle of contradiction the judicial debate, the final research has been presented.

Despite the procedural exhaustion of the fundamental consideration, the Court has not issued a decision on the basis of the case, but has disposed of a decision to discontinute the judgment of the case on the grounds that the Constitutional Court cannot take the issue under consideration to express i the basis of the case, as long as there is no decision of this body the Court cannot review such requests.

On the same day as this judgment, the Constitutional Court also reviewed the request of 1/10 of the deputies who had submitted to the Assembly the next motion on the incompatibility of the mandate of the one deputy, who opposed the decision of the Assembly not to send the matter to the Constitutional Court, treating it as a conflict of competence between the applicants (1/10 of the deputies) and the Assembly.

On this issue, the Constitutional Court, legitimizing for the first time in its jurisprudence 1/10 of the deputies as a constitutional subject, decided to resolve the conflict/dispute of competence between the Assembly of Albania and the constitutional entity in the conflict, no less than 1/10th of the deputies and the abrogation of the decisions of the Assembly on non-submission of the issue to the Constitutional Court.

● shfuqizuar vendimin e Kuvendit “Për mosdërgimin e mocionit në Gjykatën Kushtetuese” dhe;

E nderuar Presidente Claire BAZY MALAURIE,

Given the above, since a tension has been created in the functioning of representative democracy, I consider that it is necessary to get an opinion from your honored Committee, believing that your expertise would help the Assembly to respect and apply the constitutional principles and standards. In this sense, we would appreciate the Venice Commission's opinion on these questions:

1. Based on the principles of representative parliamentary democracy, can MPs be forced to vote a certain way? If there are such exceptions, what are they and do they relate to the case of motions for the compatibility of an MP's mandate? What is the mechanism, if any, to force MPs to vote in a certain way (pro, against, abstention)?

2. What are the standards for assesment of the incompatibility of the mandate of the deputy by the legislative bodies of different states and what is the role of the respective legislative body in assescing the incompatibility of the mandate of the deputy?

3. On what standards will the report between the representative mandate, non-binding, the deputies enjoy and their role as members of the Assembly in the case of the consideration of motions for the incompatibility of the mandate of the MP?

4. What is the role of the legislative body regarding the incompatibility of the mandate of the DEPUTY in other states and is there a judicial control over their decision-making? If so, in what reports is the competence that the legislative body has in this procedure compared to the competence of the relevant court? Which of these bodies exercises substantial control of the motion for assesment of the incompatibility of the mandate of the MP? What is the legally legitimate case to take the case to the court?

5. Can the Constitutional Court create a new constitutional norm, which has no relation to its interpretive competence of a norm in force? Can the Constitutional Court create a new category of applicant entities different from those taxily listed by the Constitution?

Dear Mrs. Claire BAZY MALAURIE,

Since the issues we seek the opinion of the Venice Commission are important for the balance in democracy and the resolution of the tension created by the situation of legal uncertainty in our country, for which the Assembly will have to take appropriate measures as soon as possible, we would highly appreciate your opinion in the shortest possible time.

Assuring you of the highest consideration for you and the Venice Commission, we remain pending your response.

Please find the relevant documentation on the issues on which the Venice Commission is sought opinion.

With respect,

Elisa Spiropali
