The Assembly of Albania has asked the Constitutional Court to reopen the case for the review of the mandate of Olta Xhaçka, seeking the opinion of the Venice Commission.
Through a letter, the Assembly has asked the Constitutional Court to reopen the judicial review in order to seek an amicus curia opinion (advisory opinion) from the European Commission for Democracy through Law (Venice Commission), regarding the mandate of MP Olta Xhaçka.
"Situated in the conditions where a legal uncertainty is created, as to why the group of not less than 1/5 of the deputies cannot set the Constitutional Court in motion contrary to the constitutional order in force, the Assembly is of the opinion that an opinion should be requested advisory by the Venice Commission, and regarding the applicability of these constitutional and legal provisions related to the right of 1/5 of the deputies of the Assembly to set the Constitution in motion", the request states, among other things.
