In a state of law, the role of lawyers in protecting the fundamental rights and freedoms of citizens is irreplaceable. In this sense, the arrest of a lawyer, after a tense debate with representatives of the prosecution in the courtroom, is an unacceptable event. In a NATO member state and candidate for membership in the European Union, such acts are clear signs that Albania is undoing every standard of the rule of law.
Such events require deep reflection by the governing bodies of the judicial system, the KLP and the KLGJ, so that they do not become precedents that narrow the professional spaces for effective protection of lawyers. Lawyers, like judges and prosecutors, have an essential role in guaranteeing the due process of law and any infringement of their professional activity must receive a prompt and adequate response from the competent bodies.
The misuse of arrest warrants against lawyers who request the application of legality filters by both the Prosecution and the Court, in defense of fundamental rights and freedoms, reminds us of the not-at-all-glorious past when the legal profession was banned by law.
