The special prosecution against organized crime and corruption has been investigating the case of incinerators since August 2020 and only a few days ago brought 21 people to court as accused, where it became a fact that the former finance minister Arben Ahmetaj remained outside of legal responsibility despite the fact that the evidence against him is evident in the file.

According to the lawyers, this delay of SPAK in not calling Ahmetaj is inexcusable. " Avoiding actions that contain reasonable suspicion that high public officials have undertaken during their public activity is not something acceptable. SPAK should have given it due attention, as a result, certain circumstances and facts have not been administered and evaluated , "said lawyer Isuf Shehu.

SPAK considered as evidence the tickets and hotel rooms that Klodian Zoto gave to Etleva Kondi already in the dock at GJKKO, but did not maintain the same position for Arben Ahmetaj, despite the fact that the evidence is the same. According to the lawyers, in this case SPAK is breaking the precedent.

"Judicial proceedings have at their core the law and the precedent, if the prosecution has taken a certain position in relation to a phenomenon and behavior of officials, the same evidence must necessarily be administered for other officials", said the lawyer.

The two SPAK prosecutors, Klodian Braho and Ened Nakuci, closed the investigation files for those accused of corruption with the incinerators of Fier and Elbasan. But in the investigation file, they did not touch the compromising facts about former minister Ahmetaj, whom they did not even ask.

SPAK announced that there will be a second investigation, but so far there are no clear signs that this investigation is being carried out because Arben Ahmetaj has not yet been questioned./ Tch
