On December 2, the Constitutional Court will review the request of Judges and Prosecutors for salaries.

Judges' and prosecutors' associations turned to the Constitutional Court after the approval of legal changes for magistrates' salaries, voted on by the socialist majority in the early hours of September 18.

In a joint position, the Union of Judges of Albania, the National Association of Judges, the Association of Prosecutors and the Forum of Women Judges requested the suspension of the implementation of the law, its repeal as incompatible with the Constitution and the priority review of the case.

The Assembly approved the draft law with 84 votes in favor, 24 against and one abstention. The approved formula foresees an increase in the reference salary by about 8,500 lek, but does not meet the magistrates' request for an increase of about 80 thousand lek, approved by the High Judicial Council and the High Prosecutorial Council.

Meanwhile, the government has also estimated 1.5 billion lek in arrears since April 2023, which are expected to be repaid in installments within two years.

The clash over salaries in the justice system deepened after the Assembly did not approve the new formula by July 31, according to the deadline set by the Constitutional Court.

After the deadline passed, the Supreme Court and the Supreme Administrative Court decided that, as of August 1, the reference salary would be calculated at 222,425 lek, with an additional 14,000 lek for qualification.

However, the Ministry of Finance did not execute the payrolls according to this calculation, arguing that determining salaries is the competence of the Assembly.
