Italy's Supreme Court has ruled that a five-star hotel in the Dolomites acted lawfully when it refused to serve tap water to a tourist.

The woman's arguments that "water is a natural resource and a universal human right" were unsuccessful before the court, which ruled that the waiter's decision to offer her only bottled mineral water for €7 at the restaurant of the five-star "Sassongher" hotel in Corvara, during the 2019 ski season, was justified.

The Italian Supreme Court rejected her claim for €2,700 in damages for emotional distress and economic damage, Italian media report.

Silvio Belardi, the lawyer representing the hotel, was quoted in the Corriere Alto Adige newspaper as saying that the court ruled that “there is no obligation to provide tap water.” According to Italian media reports, the tourist initially filed the lawsuit in a lower court in Rome.

She claimed that her consumer rights were violated when staff refused her request for tap water, saying that this was a key part of hotel service and comparing it to “making the sheets on the bed” and “putting soap in the bathroom”.

But the Supreme Court rejected her claim, ruling that Italian laws and regulations do not oblige bars and hotels to offer tap water to customers and that the decision to serve it is up to the businesses themselves.
