Jonida Maliqi continues the legal battle: From the 3 thousand euros seized to
Jonida Maliqi

After the court case conducted a year ago between Jonida Maliqi and Gent Prizren, legal issues between the parties are still ongoing.

The process that was completed at that time, won by Jonida Maliqi, was related to Gent Prizren's financial obligations towards his son. The case concerned the opposition to enforcement actions, after the enforcement had seized 3,000 euros from his account and transferred it to Jonida Maliqi.

Although the amount was executed in 2024, the legal process continued for about two and a half years, until the final rejection of the request by the Court. The decision was appealed twice, but without changing the result.

This was the second court case involving the same amount. In the first case, it was claimed that the 3,000 euros did not constitute an obligation to the child, as the school expenses had been paid.

Meanwhile, another lawsuit has been ongoing since 2023, initiated by Jonida Maliqi, who is seeking the indexation of the monthly obligation of 2,000 euros. This amount was determined by agreement in 2017, while the request for indexation is based on the change in the exchange rate and the level of inflation.

In 2017, the exchange rate was approximately 1 euro to 137 lekë. Consequently, 2,000 euros represented about 274,000 lekë. At the time of the start of the process, the rate had dropped to about 110 lekë per euro, while it is currently approximately 91.8 lekë.

At the current exchange rate, 3,000 euros is equal to about 275,400 lekë. According to this comparison, the change in the exchange rate alone makes 3,000 euros today represent almost the same value in lekë that 2,000 euros represented in 2017.

Another element that raises concerns is the length of this process. This is a matter directly related to the obligation to provide maintenance and financial support for a minor with special needs, while the request for the review of this obligation has been ongoing for more than three years. For a matter of such nature and which directly affects the interests and needs of a child, such a length of the process can hardly be considered normal.

The request for indexation of the amount was rejected by the Court about a year ago, but the case is still pending. On September 23, Judge Fahrije Budo, who is reviewing the process, is expected to announce the relevant decision.
