Trump: One year in prison for who burns the American flag
US President Donald Trump

US President Donald Trump signed an executive order on Monday aimed at punishing people who burn the American flag, accusing those who do so of showing hostility and contempt for the United States.

Trump has threatened for years that he will take harsh measures against burning the flag. In 2016, he wrote on social media that anyone who burns the American flag must lose their citizenship or face imprisonment.

During a speech in 2024 before the United States National Guard Association, then-candidate Trump said he would work to pass a law that imposes criminal penalties for those who burn the American flag.

In comments from the Oval Office on Monday, Trump claimed that burning the American flag "fuels unrest" and said those prosecuted and convicted as a result of his directive will face a year in prison.

"People in this country don't want to see our American flag burned and spat upon," the president said.

Titled "American Flag Burning Prosecution," Trump's executive order does not instruct the attorney general to prosecute those who burn flags for the act itself. Rather, it says the Department of Justice should file lawsuits "against acts of desecration of the American Flag that violate applicable, content-neutral laws, while causing harm unrelated to freedom of expression, consistent with the First Amendment." Examples of these laws include "violent crimes; hate crimes, unlawful discrimination against U.S. citizens, or other violations of the civil rights of Americans; and crimes against property and peace."

The directive recognizes a 36-year-old Supreme Court decision that found the burning of the flag to be speech protected by the First Amendment, but adds that "desecration of the American flag committed in a manner that is likely to incite immediate unlawful action or that is an act that constitutes 'war speech'" may not be entitled to the same protection under the First Amendment.

The order directs the secretary of state, attorney general, and secretary of homeland security to take action against foreign nationals who have engaged in "American flag desecration activity," including revoking their visas or residence permits, or seeking their deportation from the U.S.
