"Bankers Affair", did the Fier Prosecutor's Office investigate the 100 million euro fine and how did Anila Denaj suspend it?

On May 13, 2019, the General Directorate of Customs imposed a fine of approximately 100 million euros on the concessionaire company "Bankers". The reason at the time was that the company that exploits the Patos-Marinza oil field was caught violating the law by evading excise duty on fuel diluents.

The case went all the way to the Supreme Court, which upheld the fine, while the General Directorate of Customs also contracted bailiffs to collect the debt, which was a very favorable damage and interest for the Albanian state coffers.

A story that deserves at least an investigation, whether criminal or administrative, because suddenly, and with a highly controversial decision by the Ministry of Finance, which at the time was headed by Anila Denaj, the fine was suspended. In fact, it was never taken from the concessionaire company, where those responsible undoubtedly caused great damage to the state.

If a citizen who is fined, no matter how small, by state institutions is quickly paid, the exact opposite happened with the Bankers firm. In July 2019, the order issued by Anila Denaj's office, which was subordinate to the Directorate of Customs and Taxes, was justified by the alleged "complexity of the case, both in terms of the volume of the file and the amount that had to be collected."

"From the review of the materials, it turns out that we are dealing with a very important and complex problem, both from the figure found and from the time frame. In view of the above, the customs authority shall proceed with the suspension of the procedure," Minister Denaj's decision states. Simply put, the Minister ordered customs to stop the execution of the fine on the grounds that the fine was too large and that the problem was too complex.

A highly controversial decision by a very high-ranking official, especially since Bankers was caught violating the law by evading excise duty on fuel diluents. Moreover, the Supreme Court's decision is the removal of any barriers that institutions had to execute the fine and collect a sum of money.

Not only was the fine not paid, but no institution, not even law enforcement, has bothered to investigate it. To this day, the Customs Directorate has not taken any action to collect the fine, after that decision by Denaj. It seems like a very big affair, where the order came from above.

Time has passed and justice has now acted, with the arrest of several executives and former executives of Bankers. But the Fier investigations have been left in the middle, where no state official, subcontractor firm or even second-tier bank has been verified in this affair. Investigators have encountered a "high wall" to hold state officials accountable, whether Denaj or the General Directorate of Customs. To date, no tax official or AKBN official has been charged.

VoxNews reported a few weeks ago that state officials were being amnestied from the Bankers affair. Who allowed them to turn over 6 billion euros and produce balance sheets with minimal profits, the size of a neighborhood market?

"The file should definitely extend to the signatories of the concession. To those who renegotiated the agreement or to the structures of the National Agency for Natural Resources or even the Tax Directorate that allowed a terrible abuse. But also to those state officials who allowed a huge fortune to be stolen from Albanians ," was the denunciation of our editorial staff.
