Prime Minister Edi Rama declared from the podium of the Socialist Party Assembly that the current mayor of Tirana, who he said was arbitrarily and illegally arrested, will be dismissed by the Municipal Council. “The representatives in the Council must set in motion the legal mechanism for the dismissal of the current mayor for failure to appear for duty,” said Rama, who claimed that the legal framework is not very well regulated.

In fact, the prime minister made a very serious mistake, as the government and its deputies voted in 2015 for the law on “local self-government”, a law that passed with 3/5 of the Parliament and without the majority vote should not have been approved. This law clearly states that the dismissal of mayors is done by “decision of the Council of Ministers”!

Article 62 of the law on local self-government, approved by “Rama 1” in 2015

Two years after the Socialist Party came to power, Parliament voted on law number 139 of 2015. Article 62 clearly states how the mayor is dismissed;

"The mayor is dismissed by decision of the Council of Ministers in cases where:
a) he commits serious violations of the Constitution or laws;
b) he is convicted of committing a criminal offense, by a final decision, by the court;
c) he is proposed for dismissal by the relevant municipal council for failure to appear for duty for an uninterrupted period of 3 months.

In all cases, the dismissal comes from the signature of Prime Minister Rama, or his subordinates, and not from the Municipal Council. The insistence that the dismissal come from the Council is a firm order, which is expected to be implemented in the coming days with speed, to pave the way for other clans within the SP to take control of the largest municipality in the country.

In fact, Manastirliu has long extended her "tentacles" to the municipality, where together with the deputy prime minister she has taken the "reins" of management, despite the fact that Anduela Ristani is at the "head". In fact, Manastirliu's clash with Ristani also took place publicly, given that Rama's candidate dismissed his sister from the Polytechnic.

Article 61 of the Law on Local Self-Government

Meanwhile, Article 61 of the same law also defines the “premature termination of the mayor’s term of office.” According to it, the term ends prematurely in cases where he refuses to take the oath or resigns. Veliaj has not resigned, insisting, like Rama, on his innocence and that he is a prisoner without facts.

Rama's speech was more like a direct blow to Veliaj, also ordering the dismissal mechanism. This article stipulates that "in the case when the position of mayor remains vacant during the last 6 months of his mandate, the relevant council elects from among its ranks a new mayor with a majority of votes of the total number of its members, who exercises his functions until the end of the mandate."

So, if he does not appear for 6 months, a new chairman is elected by the Council until the end of the mandate. Rama "ordered" elections, which means that if he has implemented the provisions of Article 61, he should not make an election but an appointment. If he has implemented the provisions of Article 62, he should sign the dismissal himself. Does he have the courage to act?!
