Unlicensed floors will be sold at public auction. The government has approved the guide which provides how the square meters built outside the building permit will be treated, where the first procedure is their sale.
This action of the executive started last September and it has already been specified how to proceed with them. Concretely, the first is the public auction, where according to the instructions, it is said that the sale will be done according to the market value and not the property map with which the government carries out the expropriations: "The evaluation of the object is done in accordance with the real market value. Appraisal experts are responsible for the appraisal carried out, for the documents drawn up and signed by them and draw up the final appraisal report, which contains the minimum value of the auction sale".
After the evaluation with which the initial price in the auction starts, the second stage begins, how the money that will be benefited will be managed: "The procedure of transferring the real rights over the confiscated property will be developed through the public auction. The income generated from the sale will be used for expropriation, special treatment or compensation, in order to carry out public works".
The directive has also provided for a second way for floors without a permit, their giving for social housing, an act which is done only in those cases when this interest prevails over the sale, and this assessment will be made by the government itself: "Institutions interested in used the confiscated objects, will express their interest to the ministry responsible for the administration of state property, to use them for their needs. This institution, when it finds it in a fair relationship with the public interest, carries out their transfer by decision of the Council of Ministers".
This instruction is already an executive title and does not exclude from the right to purchase even those who have built in violation of the building permit.
