Entities leasing state assets over 500 square meters, leased according to contracts with a fee of "1 euro/contract", have the right to request the purchase of said assets, if it is not inalienable state property. The changes and additions to the decision of the Council of Ministers, "On the evaluation criteria of the state property, which is privatized or transformed, and the sale procedure" have been published in the Official Gazette.
According to these changes that have already entered into force, in order to benefit from the above, the tenant must meet two conditions. Firstly, the full value of the investment provided in the lease contract to be carried out by the tenant is over 5 million euros and secondly, the tenant must have invested at least a value higher than 750% of the value of the property that it is required to be privatized, within the deadline for the realization of the investment, according to the provisions of the lease contract.
In the sales contract, the buyer will have the obligation not to alienate the privatized property to third parties, until he has realized the full value of the investment provided for in the previous lease contract. Also, the right of the buyer to develop the property is defined in the contract in accordance with the previously defined project and with the legislation for planning and development of the territory.
If the obligation to make the investment is not fulfilled within the deadline, the responsible ministry, after exceeding this deadline and after having administered the act of property assessment that certifies its non-fulfilment according to the procedures, notifies the other party within 10 days of the unilateral termination of the sales contract and for therefore, the transfer of ownership in favor of the state.
