Since villages, tourist complexes, resorts, hotels, motels, guesthouses, campsites and other accommodation units erected in coastal areas, near lakes and rivers that do not treat polluted water and discharge it into the washing waters are obliged to replace skeptic pits with the installation of state-of-the-art plants.
After the publication in the Official Gazette on January 5, 2024 of the Normative Act "On taking urgent measures, for the protection and improvement of the infrastructure, for the treatment of polluted waters that are discharged near or in washing waters" the Minister of Infrastructure and Energy Belinda Balluku and the Minister of Tourism and Environment Mirela Kumbaro have signed the joint instruction which defines the technical standards that must be followed by the entities near the coastal, lake and river areas, for the replacement of skeptic pits with the installation of modern plants for the treatment of polluted water.
But the businesses raise the concern that the installation of the required plants, which as defined in the instruction will treat waste with activated sludge, costs between 80 thousand and 100 thousand euros. Business leaders said that the cost of installing the plant is unaffordable on the eve of the new tourist season. The deadline for installing the wastewater treatment plant is 90 days after the entry into force of the Normative Act.
Businesses have until the end of March to install the specified equipment or systems or, on the contrary, as defined in the Normative Act if the Task Force, after carrying out monitoring and inspection, finds that the plant or individual system is not installed in accordance with the rules technical for the treatment of polluted water, businesses will be punished with fines ranging from 1,500,000 ALL to 2,650,000 ALL. Likewise, the subjects will not be able to obtain the certificate of use for the object or project built or developed.
Guideline
The joint instruction of the Ministry of Infrastructure and Energy and the Ministry of Tourism and Environment defines the technical standards for the replacement of skeptic pits with the installation of plants.
"This Technical Regulation makes it possible to guide entities that exercise economic activity, in coastal areas and the shores of lakes and rivers or are in the process of construction or have applied for a construction permit, based on the existing capacity and technical solutions, to install treatment plants of polluted waters according to the provisions in Normative Act no. 8, dated 28.12.2023.
In its content, first of all, the allowed values of discharges from the treatment of polluted water are defined, which must be fulfilled by the relevant entities, the technology for the treatment of polluted water, which must be that of treatment with activated sludge, as well as the replacement of Septic Tanks.
On the other hand, instructions are given on how to set up the wastewater treatment plant, which should include the pretreatment unit or mechanical treatment, the biological treatment unit and the control well at the outlet of the plant.
In addition, the technical conditions for the installation of the Plant, including the process of digging, filling and restoring the surfaces to their previous state, are provided", it is quoted in the instruction "For the adoption of the technical regulation on the standards for the treatment of polluted water for entities that discharge polluted and untreated waters near or in washing waters".
In the instruction, it is determined that the technology of the wastewater treatment plant must be that of treatment with activated sludge. "All entities that have Septic Tanks must replace them with active sludge treatment plants and meet the standards on the allowed discharge values according to the definitions in Annex no. 2 of this Technical Regulation", the regulation states.
In the regulations, the capacity of the Wastewater Treatment Plant is also calculated, which will be determined according to the size of the subjects that exercise economic activity according to the definitions of Article 2, of Normative Act no. 8, dated 28.12.2023, as well as the utilization capacity.
"1. The average utilization capacity of entities that exercise economic activity per unit and room is defined as 3 people. 3. The utilization capacity per service unit is defined as 1.75 m2/person. 4. The amount of polluted water discharged by each person will be taken as 100% of the amount of water consumed, according to the methodology for setting the fees of the Water Regulatory Body. 5. The amount of water consumed for each person will be 200 liters/person/day, according to the provisions of the Decision of the Council of Ministers no. 83, dated 10.2.2021 "On the approval of technical design and construction rules for water supply and sewerage". 6. For service units, the amount of water consumed will be 40 liters/person/day based on the best European standards. 7. The capacity of the wastewater treatment plant is determined based on the pollution load it treats and is expressed in PE or "NJP, population equivalent". 1 PE = 200 liters of urban wastewater per day or 1 PE = 1 person. For service units, the determination of capacity is calculated as the ratio of the amount of water consumed per person/day to the amount determined for urban polluted water for 1 PE. Specifically, 1 person = 0.2 PE", it is stated in article 10 of the Regulation.
