8 confiscations of buildings and one transfer/ KKT approves administrative

The last meeting of the National Council of the Territory focused on constructions without permission that go to the state to be used for public interest or social housing. The government's initiative a few weeks ago has resulted in seven confiscation decisions taken by the KKT, one decision for transfer from private to the state for this purpose and two others related to administrative procedures for reviewing documents in the case of constructions without permission.

Specifically, KKT has approved the transfer of several floors from a building in the center of Tirana, this early project known as "Eyes of Tirana". In this construction, the state benefits from an area of ​​4,200 meters that has been declared to be used for housing those affected by public projects. Seven other decisions foresee the confiscation of buildings in the capital in areas such as Myslym Shyri, Elbasani Street, Kont Urani or Qamil Gurnjaku Street.

The government started the confiscation of constructions without permission and their transfer to the fund that will be used for the housing of those affected by the constructions for public interest or for social housing in the first week of September.

The Minister of Infrastructure and Energy Blinda Balluku would declare that at the government meeting a decision had been passed "On the rules for confiscation in the public interest for constructions without a permit for the purpose of profit" which concerns all buildings without a permit or for the construction of additions to the permits granted by the Municipalities.

"All buildings that have this specific type will be confiscated for public use. It will be given to those citizens who are affected by public projects or will be used as funds to expropriate all citizens who are again affected by public projects. This whole process is long, but it is aimed at discouraging construction companies that violate the law and being under the supervision of our institutions.

For every building, which already turns out to have violated the permit or for every building without a permit, there will be an investigation for those institutions that have the task of controlling the territory and this happened under their noses as we identify that there is also a tolerance from the institutions themselves to leave the companies in abuse" Balluku would say.

After that, for days, representatives of the government would appear under various buildings in the capital to emphasize that the latter was affected by the action launched to confiscate that part that had not respected the law.

KKT decisions of October 19

1. For the approval of the administrative procedures for changing development/construction permits for facilities that will be owned by the state, for social housing needs or for public interest.

2. For the approval of the administrative procedures for reviewing the documentation of buildings built without permission for profit purposes, which are confiscated for public interest.

3. For the transfer in favor of the state with a contract of promise of sale worth 1 euro, of the construction area in the object: "Multifunctional building "Eyes of Tirana" 6, 8, 9, 13, 18 and 24 floors, with 4 underground floors, Phase I", located in the Municipality of Tirana, with the developer company "Ideal Construction" sh.pk

4. For the confiscation for public interest of the object: "Hotel 5 and 6 floors, with 2 underground floors", located at RR. "Qamil Guranjaku", Municipality of Tirana, with developer company "RT MAX" sh.pk

5. For the confiscation for public interest of the object: "Residential and service building 1, 2, 3, 4, 5 and 6 floors, with 2 and 3 floors of underground parking", located at RR. "Hiqmet Buzi", Municipality of Tirana, with developer companies "Xeluks Construction" sh.pk and "Devis Construction" sh.pk

6. For the confiscation for public interest of the object: "Residential building and services 6 floors, with 2 and 4 floors of underground parking", located at RR. "Hiqmet Buzi", Municipality of Tirana, with developer companies "Xeluks Construction" sh.pk and "Laxmi Real Estate & Investment" sh.pk

7. For the confiscation for public interest of the object: "7-storey building, with 2 underground floors", built without a permit for the purpose of profit, within the building site of the object: "Residential building and services 1, 2, 3, 4, 5 and 6 floors, with 2 and 3 floors of underground parking", located at RR. "Hiqmet Buzi", Municipality of Tirana, with developer companies "Xeluks Construction" sh.pk and "Devis Construction" sh.pk

8. For the confiscation in the public interest of the object: "Complex with residential buildings and services 4, 5, 6 and 7 floors, with 2 underground floors", located on Elbasani Street, Tirana Municipality, with the developers "Xheluks Construksion" sh .pk and "City Construction INC" sh.pk

9. For the confiscation in the public interest of the surface area built without a permit for the purpose of profit, in the building: "5, 7 and 9-floor residential and service building, with 2 underground parking spaces", located on "Kont Urani" Street, Tirana Municipality , with the developer company "Fabri D" sh.pk

10. For the confiscation for public interest of the object: "Residential and service building 4 and 5 - 9 floors, with 2 underground parking", located on the street: "Myslym Shyri", Municipality of Tirana, with the developer company "Arb & Trans - 2010 s.pk

11. For the declaration of the end of the administrative procedures of applications for building permits submitted to the Territorial Development Agency, which belong to the period 2015-2018, as well as those delegated in writing by the National Agency for Territorial Planning (AKPT) ), for non-fulfillment of the conditions defined in the Decision of the National Council of the Territory.

12. Notice to the members of the National Council of the Territory on the requirements for compliance control reviewed by the Territorial Development Agency, for the period 26.04.2022 until now, according to Decision No. 1, dated 30.07.2015 "On the determination of the rules and procedures to be followed by the Territorial Development Authorities for the examination of requests for Building Permits until the approval of General Local Plans", amended./ Monitor
