Anton Gjinaj alias Pashk Rrapi, the owner of the construction company "Alesio-2014" and investor in dozens of buildings in Tirana and public infrastructure, has been released from Rrogozhina prison, where he was serving the sentence received by the Spanish justice.
The man who is considered a drug lord in several European countries and at the same time is a successful businessman in Albania, has left his cell since Friday, joining the family business in Laprakë.
The decision to release Anton Gjinaj was taken 7 days before the New Year by the judge of Kavaja Sokol Marra, who is said to have known the period of Anton Gjinaj's detention in Montenegro, the country where he was initially arrested for traffic charges. of drugs. While SPAK, through the prosecutor Vladimir Mara, continues to keep Gjinaj and his 23 properties under financial investigation.
At the same time, the judge of Kavaja, Sokol Marra, recognized the period of several months of serving the sentence in 3 Albanian prisons. And as a result, it was concluded that the person with 4 names such as Anton Gjinaj alias Pashk Rrapi alias Pashuk Gjini and Pashuk Maloku, exceeded the sentence of 8 years and 9 months of imprisonment, given by the Spanish Justice.
Based on this situation, the court decided to terminate the sentence for the prisoner Anton Gjinaj, ordering the immediate release of the businessman, if there was no other additional punishment. The execution of this decision was carried out by the lawyer of the prison of Rrogozhina together with the prosecutor of the case, causing Gjinaj to be released from Friday.
On the other hand, the Spanish authorities, in the file of the transfer of this convict to Albania, have left orders and told the Albanian side that Pashk Rrapi alias Anton Gjinaj, must serve the remaining sentence in Albania, of 3 thousand 190 days of imprisonment and set the date of June 24, 2025, for his release from prison.
But before the construction businessman was released from the cell, in September 2022, Gjinaj submitted 5 identical requests to the court of Kavaja, asking for the calculation of the detention time in Montenegro. These requests have been combined in a single case, before judge Sokol Marra.
But the latter, on November 7, 2022, has decided to declare incompetence and transfer it to the Supreme Court for legal interpretation, with the aim of dividing judicial co-competence. So whether the case should be judged by judge Sokol Marra or by judge Anjeza Buzo, who had the same request filed by Gjinaj.
On November 24, 2022, a panel of the Criminal College of the Supreme Court, composed of Ilir Panda, Albana Boksi and Medi Bici, decided that the co-competence to judge 5 requests of Anton Gjinaj belonged to judge Sokol Marra. The latter on Friday reviewed the case by calculating the days of Gjinaj's stay in prison in Montenegro and Albania. And then ordered his release from the cell.
From the material sent by the Spaniards, it appears that the man with four names was initially sentenced in 2010 by the Alicante Provincial Court to 12 years in prison. This sentence was left in effect in May 2011, reducing only the amount of the sentence, from 12 years, to 8 years and 9 months of imprisonment.
According to the investigation file, Pashuk Gjini is clearly implicated in an episode of trafficking 50 kg of heroin from the Netherlands to Spain. The file states that the construction businessman Pashuk Gjini, in 2006, concluded a cooperation agreement with another trafficker, Sulejman Shkalla, who turns out to be the brother of the former chief prosecutor of Tirana, Petri Fusha, and the owner of the "Mai-Tai" complex in Lundr of Tirana.
Among other things, the file states that:
"...at the beginning of 2006, the Greco Levante group" focused its investigations on the introduction into the provinces of "Alicante" and "Murcia" of significant quantities of heroin from Eastern Europe, pursuing several Albanian citizens, among others. Pashuk Gjini alias Maloku...".
"...during the investigations, it was proven that these citizens had agreed to introduce a significant amount of heroin into Spain and to carry out its distribution in Torrevieja (Alicante), with some other predecessors...".
At the beginning of June 2006, in the agreement made between Sulejman Shkalla, who was staying in Spain, and Pashuku, who was staying outside of Spain, they were jointly organizing the delivery to Spain of a considerable amount of heroin, for which Pashuku and proceeded to others on June 20, 2006, traveled by plane to carry out the coordination of the operation and the subsequent distribution of the drug profits.
From the intercepted conversations on June 21 and 22, 2006, it was proven that the drugs came from the Netherlands, and for this reason, at around 1:30 p.m. on June 22, 2006, they met together with Pashuku and other convicts, who coordinate actions to await the drugs that would arrive that afternoon in Spain.
The drug was transported by putting it in the wheels of cars, which, in an attempt to remove it from the wheels, were caught by the police, finding them with hands contaminated by drugs, while removing the packages. The amount of heroin was found and weighed, which was 50 kilograms, 610 grams and 88 milligrams, with an average purity of 48.4% and a market value of 1,941,623.20 Euros. In this criminal group there were not only Pashk Rrapi and Sulejman Shkalla alias Fusha, but also other Albanians, among the main ones being Julian Deblini alias Julian Gjoka, Arjan Ndoci and Dritan Gradica. albanja.com
