"Salaries are not blocked", the Ministry of Finance 'calms'

The Ministry of Finance has reacted to the request to unblock the salaries of magistrates and justice system personnel, clarifying that the salaries have not been blocked, but that the High Judicial Council and the High Prosecutorial Council have presented the August payrolls based on a different methodology than the one currently in force.

In a letter to the Supreme Court of Justice and the Supreme Court of Justice, Malaj requests that the August payroll and expenditure orders be resubmitted according to the methodology used until July, as the new changes in magistrates' salaries have not yet been approved by the Albanian Parliament.

According to the Minister of Finance, Decision No. 15, dated 17.02.2026, of the Constitutional Court is final and binding, but its implementation requires relevant legal amendments, which have been left for approval by the Assembly.

"The Ministry of Finance cannot replace the Parliament in exercising its normative function, nor can it determine, through budget execution procedures, the concrete salary formula, and even less can it execute orders coming from honorable authorities of the judicial power, which do not have the exclusive parliamentary authority to approve changes to the Albanian state budget," said the Minister of Finance, Petrit Malaj.

In this context, the Ministry of Justice requests the Supreme Court and the Supreme Administrative Court to submit without delay the August payrolls according to the parameters used in the July payroll, so that payments can be processed immediately.

"As soon as the Treasury structures have the payroll according to the parameters in force, they will proceed with priority and make payments without delay," said Malaj.

The Ministry of Finance declares to Top Channel that if the requested changes are approved by the Parliament, the institution itself will immediately take measures for their full implementation.

We recall that on August 26, the Supreme Court of Justice and two days later the Supreme Court of Justice themselves determined the reference salary of judges and prosecutors, with a significant increase, with the argument that the Assembly had not approved a new formula by July 31, even though it was bound by the decision of the Constitutional Court.
