They took up to 15 thousand euros in bribes in exchange for providing social

SPAK has closed the investigations and sent the case file against 8 defendants for corruption with social housing in Durrës to trial.

In the official announcement, SPAK says that the defendants are Gëzim Sylaj, Vasil Karasaliu, Viola Mema, Behar Luzi, Enxhi Çelaj, Gazmend Panxha, Shyqyri Dema and Sokol Sylaj .

One of the defendants promised to provide him with a social housing in the Durrës Hospital area, in return for a reward of 15,000 euros.

SPAK says that the investigations have resulted and proven that the 5 defendants, specifically Gezim Sylaj, Vasil Karasliu, Viola Mema, Behare Luzi and Enxhi Çelaj, had set up the scheme of illegal benefits, presenting themselves as employees with managerial functions in the state administration, who also had decision-making power in granting social housing located in the Spitalla area, Durrës, to interested persons, in exchange for monetary amounts, which according to them would serve to block the apartment by giving "coffees" to third parties.

"Persons interested in social housing, in addition to the advance payment of the monetary amount, would continue to submit to the defendants the documentation for following the standard procedure for obtaining social housing. Then, according to them, interested persons would be sent a confirmation SMS by the Municipality of Durrës, a period when, according to them, the winners would be announced and they would move into the apartment after a few months. After this moment, the beneficiary of social housing would be obliged to pay a minimum rent for several years, an amount which would be assessed based on the surface area per m 2  that they would benefit from.

The defendants, in collaboration with each other, between 01.02.2023-01.03.2023, have  requested  and received  irregular benefits, respectively  in 4 episodes , from several subjects  (the agent under cover, as well as from three other subjects),  monetary amounts ranging from 5,000 to 10,000 euros, to whom they have provided the ability to exercise illegal influence in the performance of duty by persons exercising public functions to enable the acquisition of a social housing in Durrës. 

Meanwhile, the other defendants,  Gazmend Panxha, Shyqyri Dema  and  Tahir Sylaj , are proven to have promised and directly given to the defendants; Gezim Sylaj, Vasil Karasliu, Viola Mema, Behare Luzi and Enxhi Çelaj, respectively, monetary amounts (in the amount of over 50,000 lek), who promised or assured them that they were able to exercise illegal influence in the performance of duty and decision-making by persons exercising public functions, in order to obtain social housing," the SPAK announcement states.

The Special Prosecution Office against Corruption and Organized Crime has completed the investigations and has  sent for trial  to the Special Court of First Instance for Corruption and Organized Crime, criminal proceedings  No. 11 of 2023,  against  8 defendants :

i. “ Exercising illegal influence over persons exercising public functions ”,  committed in collaboration with the defendants  Vasil Karasaliu, Viola Mema, Behare Luzi  and  Enxhi Çelaj  (in the episode of Agent under Cover),  provided for by articles 245/1, paragraph four, and 25 of the Criminal Code;

ii. “ Exercising illegal influence over persons exercising public functions ”,  committed in collaboration with the defendants  Viola Mema, Behare Luzi  and  Enxhi Çelaj  (in the episode of subjects Gazmend Panxha and Shyqyri Dema),  provided for by articles 245/1, paragraph four, and 25 of the Criminal Code;

iii. “Exercising illegal influence over persons exercising public functions”,  to the detriment of the subject  Sokol Sylaj,  as provided for in Article 245/1, paragraph four, of the Criminal Code.

iv. “Unauthorized production and possession of hunting and sporting weapons”,  provided for by Article 280 of the Criminal Code.

i. “ Exercising illegal influence over persons exercising public functions ”,  committed in collaboration with the defendants  Gezim Sylaj, Viola Mema, Behare Luzi  and  Enxhi Çelaj,  (in the episode of Agent under Cover),  provided for by articles 245/1, paragraph four, and 25 of the Criminal Code.

3. Viola Mema,  accused of consuming elements of criminal offenses:

i. “ Exercising illegal influence over persons exercising public functions ”,  committed in collaboration with the defendants  Gezim Sylaj, Vsail Karasaliu, Behare Luzi  and  Enxhi Çelaj  (in the episode of Agent under cover),  provided for by articles 245/1, paragraph four, and 25 of the Criminal Code;

ii. “ Exercising illegal influence over persons exercising public functions ”,  committed in collaboration with the defendants  Gezim Sylaj, Behare Luzi  and  Enxhi Çelaj,  (in the episode of subjects Gazmend Panxha and Shyqyri Dema),  provided for by articles 245/1, paragraph four, and 25 of the Criminal Code.

i. “ Exercising illegal influence over persons exercising public functions ”,  committed in collaboration with the defendants  Gezim Sylaj, Vsail Karasaliu, Viola Mema  and  Enxhi Çelaj  (in the episode of Agent under Cover),  provided for by articles 245/1, paragraph four, and 25 of the Criminal Code;

ii. “ Exercising illegal influence over persons exercising public functions ”,  committed in collaboration with the defendants  Gezim Sylaj, Viola Mema  and  Enxhi Çelaj,  (in the episode of subjects Gazmend Panxha and Shyqyri Dema),  provided for by articles 245/1, paragraph four, and 25 of the Criminal Code.

i. “ Exercising illegal influence over persons exercising public functions ”,  committed in collaboration with the defendants  Gezim Sylaj, Vsail Karasaliu, Viola Mema  and  Behare Luzi,  (in the episode of Agent under Cover),  provided for by articles 245/1, paragraph four, and 25 of the Criminal Code;

ii. “ Exercising illegal influence over persons exercising public functions ”,  committed in collaboration with the defendants  Gezim Sylaj, Viola Mema  and  Behare Luzi  (in the episode of subjects Gazmend Panxha and Shyqyri Dema),  provided for by articles 245/1, paragraph four, and 25 of the Criminal Code.

6. While  the other 3 (three)  defendants  Gazmend Panxha,  Shyqyri Dema  and  Sokol Sylaj,  accused of consuming the elements of the criminal offense:

i. “Exercising unlawful influence over persons exercising public functions” , provided for in Article 245/1 paragraph 2 of the Criminal Code.

According to the acts administered for this criminal proceeding, among other things, the preliminary information filed by the editorial staff of the investigative show "Fiks Fare" on the national television "Top Channel", we have been informed that a collaborator of this show during January 2023 was able to hold several meetings with the defendant  Vasil Karasaliu  (employee at the Water and Sewerage Company in Durrës), who promised him the benefit of a social apartment in the Durrës Hospital area, in return for the payment of the amount of  15,000 euros. 

From the entirety of the investigative actions carried out, it has resulted and proven that the defendants Gezim Sylaj, Vasil Karasliu, Viola Mema, Behare Luzi and Enxhi Çelaj had set up the scheme of illegal benefits, presenting themselves as employees with managerial functions in the state administration, who also had decision-making power in granting social housing located in the Spitalla area, Durrës, to interested persons, in exchange for monetary amounts, which according to them would serve to block the apartment through the provision of "coffee" to third parties.

Occurring before the situation when the defendants Gazmend Panxha, Shyqyri Dema and Tahir Sylaj, have not previously entered into a cooperation agreement, the commission of the above actions, charges them with criminal liability regarding the promise and direct giving of monetary amounts in the amount of over 50,000 lek, to the defendants Gezim Sylaj, Vasil Karasliu, Viola Mema, Behare Luzi and Enxhi Çelaj, in exchange for obtaining social housing by consuming elements of the criminal offense  " Exercise of illegal influence over persons exercising public functions ", provided for by article 245/1 paragraph 2 of the Criminal Code.
