Migrant camp, Court of Cassation: Assessment of safe places belongs to Italian

The Italian Court of Cassation has granted Prime Minister Georgia Meloni the right to consider whether or not the countries where the migrants come from are safe.

For the determination of safe seats, "the confirmation judge, as a guarantor of reviewing each individual case, for the effectiveness of the fundamental right to personal freedom, shall not substitute for the assessment that, in general, belongs only to the Minister of Foreign Affairs and other ministers participating in this process".

This is what judges of the First Civil Section of the Court of Cassation write in a "mediation order" regarding complaints lodged by the government against initial nonconfirmations for the retention of migrants in Albania, given by the immigration section of the Rome Court last October 18.

The Court of Cassation, in accepting the request of the Prosecutor General on the issue of the determination of safe places, has "suspended any measures" pending the decision of the Court of Justice of the European Union.

"In the dialogue between jurisdictions, the Court of Cassation participates in offering, in the spirit of sincere cooperation, its working hypothesis, without turning it into either a decision on the appeal or a legal principle that could guide future implementations."
