Veliaj's supporters during the hearing/ GJKKO writes to the police, AMP and
Erion Veliaj/ Ajola Xoxa

The GJKKO and SPAK considered the role of the State Police during the court session that took place on February 12 regarding security measures against Mayor Veliaj and 7 others to be unprecedented and dangerous.

According to the prosecution and the court, because the police did not take action, the lives of judges and prosecutors were endangered and they demanded urgent measures against those responsible.

The letter is also for the attention of the Supreme Court of Kosovo , the European Union delegation, but not the American embassy based in Tirana.

Excerpt from the letter from the GJKKO:

The Special Court of First Instance for Corruption and Organized Crime, with letter No. 589 Prot., dated 13.02.2025, with the subject "On the finding of the failure of the State Police to cooperate with the Guard of the Republic of Albania and the endangerment of the life and health of the judges of the Special Courts and administrative personnel", has addressed the Ministry of Interior, the General Directorate of the State Police, the Police Supervision Agency and, for information, the High Judicial Council and the Delegation of the European Union to Albania.

FULL letter from the GJKKO:

Given your high and ongoing interest since 12.02.2024, the date
on which the hearing for the questioning of the persons under investigation Erion Veliaj,
etc., took place, to inform you whether the Court has requested the presence of the
State Police and the Republic Guard to take measures regarding security and
public order, during the time the aforementioned court hearing was taking place, apologizing
that due to the workload we have not been able to respond to you in time, we inform you as
follows:

The Special Court of First Instance for Corruption and Organized Crime, with
letter No. 589 Prot., dated 13.02.2025, with the subject "On the finding of the failure of
the State Police to cooperate with the Guard of the Republic of Albania and
the endangerment of the life and health of the judges of the Special Courts and
administrative personnel", has addressed the Ministry of Interior, the General Directorate of
the State Police, the Police Supervision Agency and, for information, the High
Judicial Council and the Delegation of the European Union to Albania.

Through this letter, the above-mentioned institutions have been informed that:
Before the start of the court session for the questioning of the persons under investigation
Erion Veliaj, Ajola Xoxa, Elman Abule, Gentjan Sula, Meriman Palushi, Fatmir
Bektashi and Shkelqim Fusha, in order to verify the conditions and criteria for
determining the measure and the security needs, within the framework of criminal proceedings no. 27, of
2024, registered by the Special Prosecutor's Office against Corruption and
Organized Crime, crowds of protesters gathered outside the Special Court
, completely blocking the entrance to the common courtyard of the
Special Courts and SPAK.

The employees of the Republic Guard have informed the Court that they have been continuously
requested to assist the State Police in guaranteeing the perimeter outside the
Special Courts and SPAK, by establishing a security cordon with
uniformed police officers, as was done in other similar cases during the protests of
6.12.2024 and 06.01.2025.

Also, the information that was institutionally transmitted to the State Police by
the Guard of the Republic, informing them about the gathering of a
considerable number of protesters in front of the Special Courts, was
also covered by almost all media outlets, including direct links.
The building of the Special Court is guarded and protected by the Guard of the Republic of Albania
according to the provisions of Law No. 33/2021 “On the Guard of the Republic of Albania”, Article
12, point 2, letter “d” thereof, as well as the Council of Ministers Decision No. 507, dated 27.07.2022 “On an addition to
Decision No. 597, dated 13.10.2021, of the Council of Ministers, “On the determination of
personalities and other objects, which are guarded and protected by the Guard of the Republic of
Albania”, point 1 thereof, which expressly provides that: “In letter “b”, of point 2,
of Decision No. 597, dated 13.10.2021, of the Council of Ministers, after subsection “ii”
subsections “iii” and “iv” are added, with the following content: “iii. Special Structure against
Corruption and Organized Crime”; iv. Special Court against Corruption
and Organized Crime”.
In article 7, point 1, letter “l” of law no. 33/2021 “On the Guard of the Republic of
Albania”, it is expressly provided that “1. The Guard of the Republic of Albania has
responsibilities and performs the following main tasks: …l) cooperates and interacts with
the State Police and intelligence services for the protection and preservation of personalities
and objects under guard, according to the rules established in a joint agreement
between the heads of the structures”.
So, as provided for in the legal provisions and the Council of Ministers, cited above, the Guard of
the Republic guards and protects only the internal perimeter of the Special Courts
against Corruption and Organized Crime and the Special Structure against
Corruption and Organized Crime (SPAK), and cooperates and interacts
with the State Police for the protection and preservation of personalities and objects under
guard.

In addition to the above, the aforementioned institutions were informed of another
important fact regarding the situation on 12.02.2025, which was the difficulty of
judges' movement during the court session, which worsened during the evening, where
protesters not only prevented judges from leaving the court premises,
but also when they attempted to leave, their accompanying vehicles were shot at by
protesters, cursing and insulting judges and prosecutors.

Through the above letter, the Special Court of First Instance for Corruption and
Organized Crime has addressed the Ministry of Interior and the
General Directorate of the State Police to take the appropriate measures to hold
all responsible persons of the State Police,
who have not taken the appropriate measures, in accordance with the law, to avoid or monitor
this unprecedented situation, administratively or legally liable.

This court has also requested that the entire legal procedure followed
and the plan of measures taken in similar cases, such as during the protests
of 6.12.2024 and 06.01.2025, be made available to it, as well as a reasoned explanation with evidence as to why
the same practice was not followed in the case of the incident of 12.02.2025.

Currently, the court is awaiting a response from the
competent authorities, in order to pursue other institutional avenues according to
constitutional and legal provisions.
