Lawyer Ylli Manjani, invited this Thursday to the Now show with Erla Mëhilli, spoke about the recent changes to the Criminal Code, mainly on point 7 of article 28, which states that a member of a criminal organization benefits from exemption from punishment or its reduction when providing assistance.
According to Manjani, this point practically tells participants in terrorist groups or criminal gangs not to spy on their comrades, because they will not receive a reduced sentence.
" If we refer to what the draft law says, the code that was approved, because we also have to verify if this is the case, after I have seen the code, I have seen the project that entered Parliament and it seems to me that it is without changes. I am referring to this document, which we are assuming came out of Parliament like this. We must also say this, because there is no guarantee today in the age of intelligence, not artificial. If they have done this, yes, practically today they are telling these participants of terrorist groups or criminal gangs not to spy on their friends, because it is in vain, you will not benefit from a reduced sentence. As for how this stands, there is another analysis that needs to be done, so that we are not exhaustive in this part. At this moment I cannot do the analysis for you, because I still need time to look at it. How this article 28 stands with the other articles must be looked at carefully, it is not so clear-cut. In Albania, the issue of collaborators of justice has been the biggest failure. Those who have requested cooperation with the Prosecutor's Office, generally with SPAK and not only, to uncover criminal and other elements, in the vast majority have proven to be untrue, unverified and fraudulent with the law, they have lied," said Manjani.
