While the prosecutors of SPAK, Enkelejda Millonai and Arben Kraja , demanded the appearance in court of the former prime minister,  Sali Berisha, and the political debate was heated, the deputy of the Reestablishment of the Democratic Party, Luan Baçi , claimed during a TV interview that he had been summoned to SPAK, giving explanations on the issue of wealth.

The statement of the deputy of the DP for the district of Fier, passed in silence due to the great attention to Sali Berisha, whether he should go or not to face the two SPAK prosecutors in court.

Through the sources at SPAK, " Ora " was able to secure the verification file of MP Luan Baçi and the testimony that the latter gave to the officers of the National Bureau of Investigation, regarding the shares and capital he enjoys in the "Diamond Hill" tourist complex . which is located in the "Cold Water" area in Vlora.

The complaint against the deputy of the re-establishment of the Democratic Party has been filed in SPAK , by Aredin Behari , a character who twice escaped the assassination attempt organized by Skerdi Tasi, Henrik Hoxhaj and financed against 80 thousand euros by Albert Pashaj, who has already been arrested from the prosecution.

But only 15 days after Aredin Behar filed the criminal report against Fier MP, Luan Baçi , the prosecutor of the Manjola Kajana case , decided not to open a criminal case against the official of the Parliament of Albania with the argument that the fact presented in the report does not constitute a criminal offense .

The decision not to start the investigation was made on July 6, 2023, exactly the same day when MP Baçi was called to SPAK and gave explanations regarding his wealth.

Aredin Behari, claims that Luan Baçi, currently a member of the Parliament of Albania, stole his property and did not declare his income as subject to the law "On declaration and control of assets, financial obligations of elected officials and some public servants in the period that was Director of the Fier Regional Directorate of Road Transport Services (DRShTRr)

In the report, Behari submits that in 2008 he founded and was the sole shareholder of the company " Geral AM " shpk .

On September 31, 2009, he sold 50 percent of the shares to Krienko Memo. After that, Aredin Behari sold 10 percent of the shares to Elsa Baçi, who, with the general power of attorney dated February 15, 2010, appointed her husband, MP Luan Baçi, as full-paid representative.

Aredin Behari says that on July 8, 2012, the partners of "Geral AM" made an agreement.

Where the partners have agreed to accept the request of the partner Aredin Behari, who in this period was unable to finance, to sell all his taxable parts of the service premises, swimming pools, garages, and other auxiliary parts of building "B" with the exception of 21 apartments with an area of ​​1,444 m².

Due to the impossibility of financing, the partners have accepted Aredin Behari's request to use, in addition to cash financing, the possibility of clearing with subcontractors, but with the approval of the two administrators Krienko Memo and Aredin Behari.

In continuation of the activity, the partner Elsa Baçi has benefited from several areas and premises in the object "B" and "A" of the tourist complex "Diamond Hill" in Vlora.

Aredin Behari, of his own accord, sold the terrace of the "A" building to partners Elsa Baçi and Krienko Memo.

On April 10, 2012, Aredin Behari sold 40 percent of his shares to Krienko Memos, divesting himself of the rights related to the partnership.

Krienko Memo and Elsa Baçi, being sole partners, have continued their commercial activity by investing in the "Diamond Hill" complex.

As far as Aredin Behari has submitted, he claims that the co-husband of Elsa Baçi, Luan Baçim, at the time these assets were placed, was the Director of Road Transport Fier and that he did not declare these assets to the ILDKPKI.

Aredin Behari, claims that Elsa Baçi's wealth at the beginning of the commercial activity in 2010 was in the amount of 450 thousand euros, and so far this activity has generated income for which the complainant claims that from the data available to Luan Baçi, she has not declared in ILDKPKI and that he has hidden them over the years.

For this matter, the prosecutor Manjola Kajana has carried out several verifications in the ILDKPI, the Road Transport office and businesses.

At the same time on July 6, 2023, the day when prosecutor Kajana closed the file, she interrogated the deputy of the Parliament of Albania, Luan Baçi.

In his statement, deputy Baçi explains that he has been engaged in private activity since 1997. He further explains his employment history and that in 2007 he was appointed Regional Roads Director of Fier District and in 2008-2013 he performed the duties of Director of the Fier Regional Directorate of Road Transport Services.

"...from 2013-2017 I was employed at the "Diamond Hill" resort, and then in September 2017 until today, I exercise the function of a deputy of the Parliament of Albania. I have not exercised commercial activity during the period that I have exercised public functions and that his wife has had commercial activity since 2000 in Fier..." - testified Luan Baçi.

The DP MP also explains how his wife acquired the ownership of the shares of the entity "Diamond Hill Resort, a commercial entity that had the initial name "Geral AM" and further "Krienko Group" shpk.

Following his statement, Baçi explains that his wife bought the shares and that he does not own any real estate near the "Diamond Hill" resort.

Baçi in his testimony says that Elsa Baçi has benefited from the tax share in the building built according to the share quota she has and that the facilities and premises in "Diamond Hill" are the property of the commercial entity and the shareholder benefits from income only from the sale and dividend.

Asked if Luan Baçi himself has performed legal actions on behalf of the commercial entity where his wife is a shareholder, among other things, he declares that:

"...I want to explain to you that from November 2013 to September 2017, when I was elected as a member of the Parliament of Albania, I was employed at "Diamond Hill" shpk as an administrator. During this period, I carried out actions for this subject but did not But I don't want to cry because I also have a power of attorney from my wife to carry out actions on behalf of my wife, specifically for that part of the shares that she owns, this power of attorney must have been made sometime around 2009- 2010...".

Asked about the relationship with the other shareholders of "Diamond Hill" (former GeralAM) Krienko Memo and Aredin Behari, Luan Baçi explains about Krienko Memo that he has a son, while for Aredin Behari he declares that:

"...I know Aredin Behar initially as a resident of Fier and as a person who has been doing business after 1997. I have not had company or friendship with him. I know that Krienko made a partnership with Aredin for the entity "Geral AM", where then my wife bought the shares. That's all I know about this person. I remember, once I was at the table with Krienko and Aredini, during the period when we were negotiating when Aredini was going to sell the shares...".

In the statement given to SPAK, MP Luan Baçi explains that for the first time he made the Asset Declaration in 2013, since with the legal changes of 2012, Directors of Directorates became declaring subjects.

Immediately after the administration of the testimony of deputy Baçi, the prosecutor of the case, Manjola Kajana, decided not to start the criminal proceedings, arguing that the typical fact of criminal illegality is missing.
