Corruption and abuse of office, SPAK handcuffed 4 municipal officials

By order of SPAK, the police have arrested 4 officials of the Municipality of Dimal, on charges of corruption and abuse of office.

The Special Prosecutor's Office against Corruption and Organized Crime in cooperation with the National Bureau of Investigation and the General Directorate of the State Police has conducted investigations within the framework of criminal proceedings no. 214 of 2020, for the criminal offenses "Passive corruption of persons exercising functions public", "Exercising illegal influence on persons exercising public functions" and "Abuse of duty", provided by articles 259, 245/1 and 248 of the Criminal Code.

After carrying out numerous investigative actions, at the request of the Special Prosecutor's Office, the Special Court of First Instance for Corruption and Organized Crime, with decision no. 8 dated 12.02.2023, has decided:

1. The determination of the security measure "Arrest in prison", provided by article 238 of the Code of Criminal Procedure for the person under investigation A.Ç. (with the duty of chief of transport at the time of the commission of the criminal offense at the Dimal Municipality), suspected of the criminal offenses of "Exercising illegal influence on persons exercising public functions", carried out in cooperation, provided for by Article 245/1/2 and 25 of the Penal Code and "Passive corruption of persons exercising public functions", provided by article 259/1 of the Penal Code.

2. The appointment of the security measure "Arrest in prison", provided by article 238 of the Code of Criminal Procedure, for the person under investigation AP (as director of the Urban Planning Office, Dimal Municipality), suspected of the criminal offenses of "Abuse of duty ", carried out in cooperation, "Exercise of illegal influence on persons exercising public functions", carried out in cooperation, "Passive corruption of persons exercising public functions", provided by articles 248, 259/1, 245/1 and 25 of the Penal Code.

3. The appointment of the security measure "House arrest", provided by article 237 of the Code of Criminal Procedure, for the person under investigation VJ (on duty at the time of the criminal offense head of urban planning at the Dimal Municipality), suspected of criminal offenses of "Abuse of duty", carried out in cooperation and "Exercise of illegal influence on persons exercising public functions", carried out in cooperation, "Passive corruption of persons exercising public functions", provided by articles 245/1, 259/ 1, 248 and 25 of the Criminal Code.

4. The determination of the security measure "Arrest in prison", provided by article 238 of the Code of Criminal Procedure for the person under investigation A. Ç. (acting head of IKMT, Dimal Municipality), suspected of the criminal offense of "Abuse of Duty", provided by article 248 of the Penal Code.

5. Caktimin e masës së sigurimit “Arrest në burg” parashikuar nga neni 238 i Kodit të Procedurës Penale për personin nën hetim A. D. (me profesion inxhinier pranë një shoqërie tregëtare), i dyshuar për kryerjen e veprës penale të “Ushtrimit të Ndikimit të Paligjshëm ndaj personave që ushtrojnë funksione publike”, parashikuar nga neni 245/1 i K.

6. Caktimin e masës së sigurimit “Arrest në burg” parashikuar nga neni 238 i Kodit të Procedurës Penale për personin nën hetim V. K. (me profesion ekonomist, menaxher i një shoqërie tregëtare), i dyshuar për kryerjen e veprës penale të “Korrupsioni aktiv i personave që ushtrojnë funksione publike”, parashikuar nga neni 244 i K. Penal.

On 14.02.2023, the General Directorate of the State Police executed the security measures determined by decision no. 8 dated 12.02.2023 of the Special Court of First Instance for Corruption and Organized Crime.
