The Supreme Court has overturned the decision of the Court of Elbasan for Florenc Çapjan .

The team composed of Ilir Panda, Sokol Binaj and Sandër Simoni examined the appeal of the Prosecutor's Office of Elbasan, which objected to the dismissal of the case for the murder of the former traffic police officer, Fadil Mema . 

Regarding the event, on November 20, 2019, judge Tomor Kullolli decided to suspend the case for Florenc Çapjan, releasing the latter from the cell.

His release was made with the claim that the Court does not have enough evidence to implicate Çapjan. The Durrës Appeal took the same decision. Judge Anita Mici also found the lack of evidence, almost a year later, on April 14, 2020, even though the Prosecutor's Office requested a prison sentence for the attempted assassination. Both of these judges are dismissed from the vetting process.

However, the Prosecutor's Office of Elbasan appealed to the Supreme Court, which decided today to return the case to the Court of Elbasan in a preliminary hearing. Thus, Çapja will once again face the charges of "premeditated murder" and "unlicensed possession of combat weapons".

"The annulment of decision no. 3096 (13-2019-6955), dated 20.11.2019, of the Judicial District Court, Elbasan and decision no. 10-2020-480 (76), dated 14.04.2020, of the Court of Appeal, Durrës and sending the case for retrial to the Judicial District Court, Elbasan - the judge of the preliminary session, near this court."
