Socialist MP Erion Braçe has been declared innocent by a decision of the Special Court, following the defamation lawsuit filed against him by a businessman identified as Anduel Çekrezi.
A complaint has been filed against the socialist MP by businessman Anduel Çekrezi, in the context of a long-standing property conflict in the Imshtë area of Lushnje.
The case concerns claims of the occupation of residents' land for the construction of a photovoltaic park.
The businessman has presented the relevant ownership documentation, claiming that the land was purchased in a regular manner, while MP Braçe insists that it is public land, even claiming that part of the river has been privatized.
The situation gained attention after public denunciations by the MP, who claims that the land near the Seman River, traditionally used by residents, is being illegally taken for private interests. On the other hand, the businessman disputes these claims and has turned to justice to clarify the legality of ownership and civic dignity.
Today, the Special Court heard both parties and the defense attorney of businessman Anduel Çekrezi, dismissing the defamation claims against Erion Braçe and acquitting the latter.
"This trial did not arise as a political debate. The victim is not presented as a public figure but as a citizen seeking to exercise his rights. In a democratic society like ours, the citizen must be protected and when the tendency is that the statements of a deputy are based on proven facts. Mr. Anduel Çekrezi and his brother have full property titles, issued by Albanian institutions and not proven in court. The accused declares that the IMSH has emerged as the owner, that the owners take the river land and this is a discriminatory accusation. The narrative is created that Çekrezi is not the owner but the beneficiary of public property. The declaration turns out to be untrue," said Anduel Çekrezi's lawyer.
Anduel Çekrezi: Today I do not want to dwell on legal arguments, but I want to speak as a citizen. I came to Tirana at the age of 14, I have not had any benefit from public property or state privilege. For me, this issue has never been a property issue, I was denigrated by a high-ranking official who held the position of deputy prime minister. The law protects the reputation of citizens. Over the years, I have built institutional relationships inside and outside the country. For this reason, when a citizen is denigrated, the damage affects everything that the citizen has built with his hard work and sweat. Hundreds of verifications have been carried out for this property. What impressed me was not the discussion on property rights, but the suggestion that we give up. Does a person in power have the right to direct investment policies and then label them? I realized that the problem was not the land I had bought. I am not afraid, and the clear message that should come out of this court is that defamation cannot be used to subjugate.
Erion Braçe: Thank you very much for allowing me to resolve this issue through the courts. Thank you for the time it took to discuss this issue here in court. In our country, you can talk and talk and you have officials who do not comply with the law, even when you tell them that there is a law in force, they still say they do not know that law. So this is a very good opportunity. Because the essence of the lawsuit that was filed against me in my capacity as a deputy, but aims to legitimize the property there and aims to silence a deputy of the republic.
