The High Court has undertaken a procedural change in the judicial process related to former Interior Minister Saimir Tahiri and former Vlora Police Director Jaeld Çela, replacing the judge rapporteur of the case.

Initially, in 2022, the draw had determined Judge Sokol Binaj as the rapporteur of the case. However, in December of last year, Binaj submitted his resignation from this position, leading to the reassignment of the case.

Judge Genti Shala, who was recently appointed to the High Court, has been appointed as the new rapporteur.

The reason for Judge Binaj's resignation is related to the fact that he was previously part of the review of several judicial requests submitted by Saimir Tahiri, at the time when he was exercising his duties in the former Appeal for Serious Crimes. In order to avoid any conflict of interest or doubts about impartiality, he has decided to withdraw from the case.

The process in the High Court was initiated following the appeal filed by the Special Prosecution Office (SPAK), which opposes previous decisions of lower courts.

SPAK disagrees with the fact that Tahiri was convicted only for the criminal offense of abuse of office and demands that the former minister be found guilty also of drug trafficking and participation in a structured criminal group.

For these charges, the prosecution is seeking a sentence of 12 years in prison.

Initially, the former First Instance Court for Serious Crimes had found Tahiri guilty of abuse of office, sentencing him to 5 years in prison. Due to the summary trial, the sentence was reduced to 3.4 years, while the final decision suspended the execution of the sentence and placed him on probation.

This decision was appealed by both parties, both SPAK and Tahiri himself. The appeal of the GJKKO overturned the decision to suspend the sentence, leaving the sentence of 3.4 years in prison in force. After serving part of the sentence, Tahiri was released from prison by decision of the Elbasan Court, due to family circumstances and the conditions provided for in the law, without fully completing the execution of the sentence.

Currently, the High Court is awaiting not only the setting of the date of the court session, but also the selection of two other members of the judging panel, who, together with rapporteur Genti Shala, will review both the appeal of SPAK and the one presented by Saimir Tahiri, who seeks complete innocence.
