The Brazilian Supreme Court has rejected the request for the release of Ervin Mata while his arrest continues during the extradition process.
The Federal Supreme Court of Brazil has decided to maintain in force the preventive arrest for the purpose of extradition against Albanian citizen Ervin Mata , rejecting the defense's request to lift the arrest measure and replace it with other coercive measures.
The decision is dated July 21, 2026 and was taken by Minister Alexandre de Moraes , rapporteur of extradition case no. 1.925, where the applicant is the Government of the Republic of Albania.
According to the court document, Albania requests the extradition of Ervin Mata for criminal proceedings for suspected acts of drug trafficking, committing criminal acts within the framework of a criminal organization and a structured criminal group, as provided for by the relevant articles of the Criminal Code of the Republic of Albania.
The decision describes the entire chronology of the procedure. The court notes that the preventive detention measure against Mata was ordered on March 11, 2025, while his arrest by the Brazilian Federal Police was carried out on April 25, 2026.
Following the arrest, the Federal Supreme Court conducted the procedures for questioning the person sought for extradition, while the defense presented its objections and requested the dismissal of the extradition request or the replacement of the arrest with alternative measures.
Ervin Mata's lawyers claimed that Albania had not respected the legal deadline for formalizing the extradition request.
According to them, other issues related to jurisdiction over the alleged criminal offense should also be considered.
The Brazilian Supreme Court rejected this argument.
In his reasoning, Minister Alexandre de Moraes emphasizes that the documents show that the formal request for extradition was filed with the Brazilian authorities on March 7, 2025 and was reconfirmed through Note Verbale No. 46/2026 of the Embassy of the Republic of Albania, forwarded on July 2, 2026.
According to the decision, this documentation proves the continued interest of the Albanian state in extradition and fulfillment of procedural requirements.
The court also refers to the position of the Attorney General's Office of the Republic of Brazil, which had come out in favor of accepting the extradition request and against the release of Ervin Mata.
The decision argues that preventive arrest in extradition proceedings is an essential measure to ensure that the requested person is at the disposal of the authorities and to enable the implementation of a possible positive extradition decision.
Minister Alexandre de Moraes assesses that in this specific case there are no exceptional circumstances that would justify lifting the arrest, also mentioning the risk of the wanted person fleeing.
In conclusion, the Federal Supreme Court of Brazil ruled:
– the rejection of the request to revoke the preventive arrest against Ervin Mata;
– failure to replace arrest with other security measures;
– the rejection of the defense's requests for further investigative actions.
With this decision, Ervin Mata remains in custody in Brazil, while Albania's request for his extradition continues to be reviewed.
The decision of the Brazilian Supreme Court relates only to the procedural measure during the extradition process and does not constitute a decision on his guilt or innocence for the charges brought by the Albanian authorities.
