The Italian government is considering legal maneuvers on how to avoid the blockade of domestic courts on the implementation of the agreement signed with Albania on migrants.

The options on the table are not numerous and one of them, as Italian media write, is the legal transformation of these two centers, from reception centers for immigrants caught in the international waters of the Mediterranean, into shelter centers for immigrants with illegal status caught in Italy and for whom there is a deportation decision.

The legal transformation of these two centers would avoid a clash between Giorgia Meloni's government and the local courts. According to the Italian Minister of European Affairs, Tomaso Foti, the change of the object of the two centers should happen before the end of March, when the European Court of Justice is expected to issue a ruling regarding the clash over the transfer of asylum seekers to Albania.

The Italian minister proposes that the transformation of two asylum-seeker reception centers into repatriation centers could be done through a law. However, citing international law experts and legal scholars, Italian media write that changing the status of the two centers violates the agreement with Albania.

According to them, the agreement provides for the reception and temporary shelter of asylum seekers who are intercepted and detained by Italian authorities in international waters in the Mediterranean and not for the shelter of illegal immigrants who have a deportation order from Italian authorities. Generally, this category includes people with criminal records, including those who, after serving various sentences in Italian prisons, are deported from the country.

This is why Giorgia Meloni's law will not be enough, but approval from the Albanian side will need to be sought to change the scope of work of the two centers established in Albania.
