The Special Prosecutor's Office against Corruption and Organized Crime has sent the case of the Elbasan incinerator for trial. 10 people are under indictment, from the former Minister of the Environment Lefter Koka, arrested in December of last year, and the former socialist deputy Alqi Blako, arrested in March of this year, to the officials of the procurement commissions, and the entrepreneurs involved, who are on the run, Stela Gugalla, sole partner and administrator of the company "Albtek Energy" sh.pk, which won the concession, Klodian Zoto, sole partner and administrator of "Integrated Technology Services" sh.pk, the company that undertook the construction , as well as Mirel Mërtiri, considered by the prosecution as the real owner of the company "Albtek Energy" sh.pk.
The prosecution explains that "from the conducted investigations it has been proven that in the procedure of granting the concession and in the conclusion of the contract with the object "Construction and administration of the urban waste treatment plant of the Elbasan District, for the production of energy", they were not fully completed preparatory actions for granting the concession". Likewise, "the investigations also proved the fact that the regular legal procedure was not implemented regarding the type of procedure that was used for granting the concession", contrary to the legal framework and the suggestions of the Ministry of Finance and the Public Procurement Agency. For this reason, the charge of "Abuse of duty" is heavy for all seven officials.
As for the former Minister of Environment Lefter Koka, and the three businessmen, there are also two other accusations of "Corruption" and "Money Laundering" carried out in cooperation. According to the prosecution, fictitious invoices were received through the companies involved and payments were made for unfinished work for nearly 3 million euros. More than 90 percent of this value, according to the prosecution, went in the form of bribes in favor of former minister Koka, "using several other commercial companies indirectly controlled by him, controlled by his family members , as well as controlled by the commercial entities in his possession".
Investigations have also been closed for the Fier incinerator, where the same entrepreneurs are involved, as well as ex-minister Koka and ex-MP Alqi Blako, in addition to other local officials, or leaders of private commercial companies.
There have been numerous debates on the case of incinerators and doubts have been raised that many aspects or facts that have come to light have not been properly investigated. But the prosecutor's office clarified today that it decided to divide the criminal case for "the circumstances and facts related to the allegations that actions were carried out in violation of the law in the procedure of passing the draft decision proposed by the Ministry of Environment for approval in the Council of Ministers on the basis of which the government's decision was subsequently approved, which approved the provision of the necessary financing of the concession contract".
The preliminary investigations for possible abuses by officials of various ministries are also continuing, "including the evidence and documents that were found and were extracted from the computers seized in the apartment of the defendant Klodian Zoto".
According to the prosecution, the allegations that there was a lack of control in the implementation of the concession contract, or the circumstances and facts related to the other persons under investigation, natural persons and legal persons, or other possible collaborators, who are suspected of having collaborated with the defendants for money laundering, or other elements./VOA
