SPAK has often been accused of issuing prison arrest warrants without having any evidence, and for this it has been opposed by experts, who state that it is not acting properly.
Former prosecutor Shkëlqim Hajdari is of the same opinion, who has called on prosecutors and judges to reflect on the imposition of the security measure of prison arrest.
He said that this measure is imposed only for serious crimes and that democratic countries do not have it essential.
"Despite the fact that many years have passed in democracy, we still do not use "imprisonment" as a security measure as the legislator intended it to be used. "Imprisonment" is an exceptional measure, imposed under specific conditions and does not equate to the guilt or innocence of an individual under investigation. It does not mean that if you have arrested a person he is guilty. If you arrest him and you don't have the hard evidence, then you fall into subjectivism and you are obliged to take him to court. This is the truth that happens. And I continue to believe that the prosecutors and judges of the Republic of Albania should finally reflect deeply on the establishment of this security measure. Because in light criminal offences, there is no need to impose the security measure of arrest and imprisonment. This measure is imposed for serious crimes,
In democratic countries, the measure of arrest is not essential, but they have the collection of evidence in a legal way and on the basis of legal evidence, the declaration of guilt. So you can be investigated at large and when you go to court you are sentenced to 20 years in prison and go to prison. This is not happening in Albania.
If you detain a person in prison and then go to court and he is found innocent, that's... Better for the prosecutors to take other measures and then take him to court." he said.
