Rama's attacks on justice, ILD leader Metani: Unacceptable!
Arthur Metani

"Justice is being put under unconstitutional pressure, but it must exercise restraint in its reactions, even when the attacks are unjust."

This was stated by the head of the High Inspectorate of Justice, Artur Metani , regarding recent developments and the attacks that have been made, even by the politics of Prime Minister Edi Rama, against certain judges, for the decisions they make.

He noted that these attacks were unacceptable and that independence and the separation of powers should not be just rhetoric.

"It's been a while since the judicial system has been under pressure, which I consider unconstitutional, to exercise its duties or not, in a certain way. From everyone. It's been a long time since insults to magistrates have been a significant part of the articulation when it comes to criticism of the judicial power. Of course, these are unacceptable in every respect. This puts magistrates to a difficult test. But the test of independence, of the separation of powers and the rule of law is not just rhetoric," Metani says.

The statement was made during a meeting organized by the High Inspector of Justice, in cooperation with the Matra project of the Government of the Kingdom of the Netherlands. This is a high-level meeting with justice institutions to discuss issues of judicial independence and accountability.

And coming to the point of the judiciary's response to these attacks, Metani underlined that restraint is needed:

"Unlike other powers or institutions, magistrates and independent justice institutions have a kind of limitation, which comes with the duty to show restraint, even when they are unjustly attacked. Among strong public voices, this makes them perceived as weak, but this is not the case at all. Restraint should not be confused with weakness. Despite the statements of various public actors, magistrates should not forget that public reactions are not part of their function. But, restraint is! Restraint is not a weakness of any kind, but respect for freedom of expression in a democracy, it is a constitutional distance from the political nature of other powers."

The head of the ILD also emphasized the public's trust in the judiciary, advising them not to forget this element for a moment, despite the conditions in which they worked, with an overload of files, a lack of staff, and pressure from occasional attacks.

"Never forgetting at any moment of our working day the conditions in which magistrates work, the heavy caseload, the insufficient number of magistrates in the system, the increase in users of the judicial system, the fair and unfair expectations from the judicial system, I again believe that public trust in the judiciary is the most precious value of justice, but also its best protection," he said.

And finally, some advice for magistrates to stay away from political deontology, so that it does not dictate their behavior.

"Political deontology should not dictate the behavior of magistrates. In this case, I believe that the essence of the rule of law and European values is precisely the way we behave, even when we disagree with each other's decisions," he concluded.
