The head of SPAK, Altin Dumani, has withdrawn from the statement he gave to the members of the High Prosecution Council that the Special Courts should be "notaries" of the charges of the Special Prosecution.
After the uproar created by Duman's statements, SPAK in an announcement in the afternoon says that the media has taken the words of SPAK's chief prosecutor out of context.
The Special Prosecutor's Office states that " it is a prosecuting body which, for each of its procedural and substantive actions, is controlled by special courts according to legal provisions. Special Courts make decisions only based on the law and the facts of the cases. The Special Prosecution fully respects their decisions and appeals them through the instruments provided by the law".
"We note with concern that the media has taken out of context a part of the speech of the Director of the Special Prosecution during the annual report today near the KLP regarding the number of guilty verdicts given by the GjKKO, completely deviating the answer that the Director of The Special Prosecutor gave this aspect to the question of the KLP member.
In respect of the public and the rule of law, we clarify that the Special Prosecutor's Office emphasizes that it is an accusing body which, for each of its procedural and substantive actions, is controlled by subsequent courts according to legal provisions. Special Courts make decisions only based on the law and the facts of the cases. The Special Prosecutor's Office respects their decisions to the maximum extent and appeals them through the instruments provided by the law and when the special prosecutors consider that they have legal reasons to exercise this competence of theirs.
The Special Prosecutor's Office recognizes and respects with the same seriousness whether the decisions of guilt or innocence given by special courts or the Supreme Court and the Constitutional Court" , announced SPAK.
But what did Duman declare?
Dumani was asked during the reporting in KLP about the concern expressed by the civil society and human rights protection activists that the security measures required by the special prosecutors for persons under investigation are extreme and despite this, the Special Court approves all requests , without taking into account any mitigating criteria, while lighter security measures can also be applied, such as house arrest, obligation to appear or even property guarantees.
But Dumani said that the courts give decisions according to SPAK's requests.
"...as I said that every case of innocence is appealed by the prosecutors and the courts decide what we ask for, even in relation to the guilty declaration of the subjects we send for retrial", said Dumani. The statement that he brought this afternoon and the "clarification" notice full of spelling mistakes of SPAK.
