Ogerta Manastirliu's resignation from her mandate as an MP, after deciding to run for the Municipality of Tirana, has opened a legal and political debate on how the remaining vacant "seat" in the Albanian Parliament will be filled.

According to Kreshnik Spahiu, this case constitutes concrete evidence regarding the implementation of the principle of legality and constitutional order in the Albanian electoral process.

Through a post on social networks, the analyst and former politician emphasizes that legally the mandate left vacant by Manastirliu should be passed to Xhema Qefalisë , who in the May 11 elections received over 9 thousand votes, more than the other candidate Blerina Gjylameti, who is rumored to be the next member of Parliament due to respecting the legal quota.

But, according to Spahiu, the legal quota does not affect this case, as the minimum representation of women on the open list is already met.

According to official calculations, the Socialist Party in Tirana has seven mandates won from the open list, two of which are held by MPs Denaj and Xhaçka. Given that the minimum gender representation quota is one-third, the legal criterion is already met.

"Mathematical analysis of the quota and ranking: • PS open list: 7 mandates; • Number of elected women: 2 (Denaj, Xhacka) • Minimum number of women according to the 1/3 quota: 7 ÷ 3 ≈ 2,333 → rounded down = 2; • Conclusion: the gender quota is already fulfilled, therefore the vacancy does not change the ranking. Also, in the closed list of the DP, nearly half of the deputies are women. So, any attempt to give the mandate to another candidate, such as Blerina Gjylameti, would be in open violation of the law and precedents," Spahiu writes, while further bringing up the case of the Democrats in Durrës, where the mandate went to Arjan Ndoja and not Andia Ulliri, despite the fact that the latter appealed, claiming respect for the gender quota.

Who legally belongs to the vacant mandate of Manasterliu: Xhemal Qefalisë or Gjylameti?

The resignation of MP Ogerta Manastirliu, who decided to run for the Municipality of Tirana, is not only a political development, but also a clear test of the principle of legal order in the Albanian electoral system. The issue is expected to be a battle in the Constitutional Court: Who takes the vacant seat in the Assembly?

According to Articles 152 and 153 of the Electoral Code (Law No. 10019, dated 29.12.2008, as amended):

Neni 152, pika 3: “Në rast dorëheqjeje, vdekjeje ose paaftësie për të ushtruar detyrën, vakanca e një deputeti plotësohet automatikisht nga kandidati i radhës në listën e partisë, siç rezulton nga vendimi për shpalljen e mandateve.”

Neni 153, pika 1: “Renditja e kandidatëve në listat e partisë pasqyron votën e qytetarëve dhe nuk mund të ndryshohet nga partia pas shpalljes së rezultatit.”

Ky kuadër ligjor është i qartë: mandati nuk mund të mbetet bosh, nuk mund të cenohet nga preferenca e brendshme e partisë dhe duhet të plotësohet sipas renditjes së listës që ka votuar populli.

Një precedent i njohur është rasti i deputetit Arjan Ndoja i cili fitoi të drejtën e marrjes mandatit për shkak të renditjes dhe nuk u pengua nga kuotimi gjinorë.

Megjithë ankesat dhe prerendimet e kandidates Andia Ulliri për kapërcim renditje dhe prioritet gjinor të femrave, KQZ dhe Kolegji vendosën të mos ja pranojnë sepse PD kishte plotësuar % e nevojshme për përfaqsimin e grave.

Një nga interpretimet e mundshme që mund të ngrihet është: a ndikon kuota gjinore për të përcaktuar se kush merr mandatin e lënë bosh? Në këtë rast, PS ka 19 mandate në total, por 7 janë të listës së hapur, ku janë zgjedhur dy deputete gra: Denaj dhe Xhacka.

Nëse kuota llogaritet vetëm për listën e hapur, numri minimal i grave që duhet të përfaqësohen është mbi kuotën minimale.

Rrumbullakuar poshtë, rezulton 2 gra, pra kriteri gjinor është tashmë i plotësuar me Denaj dhe Xhacka. Kjo do të thotë që mandati i lënë bosh nuk pengohet nga kuota gjinore dhe i takon automatikisht kandidatit të radhës, Xhemal Qefalia.

Ky trajtim është i ngjashëm me vendimin e KQZ për PD dhe Andia Ullirin, ku kërkesa për të ndryshuar kandidatin për shkak të kuotës gjinore u refuzua dhe mandati iu dha kandidatit të radhës sipas listës.

Analizë matematikore e kuotës dhe renditjes

 Lista e hapur PS: 7 mandate

 Numri i grave të zgjedhura: 2 (Denaj, Xhacka)

 Numri minimal i grave sipas kuotës 1/3: 7 ÷ 3 ≈ 2.333 → rrumbullakuar poshtë = 2

 Përfundimi: kuota gjinore është tashmë e plotësuar, prandaj vakanca nuk ndryshon renditjen. Gjithashtu në listën e mbyllur të PD afro gjysma e deputeteve janë gra.

Pra, çdo tentativë për t’i dhënë mandatin një kandidati tjetër, si Blerina Gjylameti, do të ishte në kundërshtim të hapur me ligjin dhe precedentët.

Dorëheqja e Manastirliut dhe plotësimi automatik i mandateve sipas listës janë më shumë se një detyrim formal. Ato:

Ruajnë integritetin e votës së qytetarëve.

Sigurojnë rendin ligjor dhe stabilitetin politik.

Parandalojnë manovrat e brendshme që mund të cënojnë besimin në institucionet demokratike.

Ligji është i prerë: vakanca e lënë nga Ogerta Manastirliu plotësohet nga kandidati i radhës në listën e PS, Xhemal Qefalia. Precedentët (Arjan Ndoja, Andia Ulliri) dhe llogaritjet e kuotës gjinore janë të qarta dhe nuk lënë hapësirë për interpretime të tjera.
