The Constitutional Court has rejected the request of a group of DP deputies, who requested the repeal of the law widely known as the "Reconstruction Law".

At the time when the DP was led by Lulzim Basha, it was considered a clientelistic law, referring to contracts for the construction of apartments and schools.

On June 28, the Constitutional Court announced, the lawsuit was taken under consideration, but the required number of votes for decision-making was not reached and it was decided to drop the request.

Full notice of the Constitutional Court:

The Constitutional Court of the Republic of Albania on 28.06.2022 took into consideration in a public plenary session the case with the applicant a group of deputies of the Assembly of Albania (not less than one fifth of the deputies), with the object: "The partial repeal of law no. 97/2019 "On the approval of the normative act with the power of law no. 9, dated 16.12.2019 of the Council of Ministers "On coping with the consequences of natural disasters", as incompatible with the Constitution of the Republic of Albania. The partial suspension of the implementation of law no. 97/2019 "On the approval of the normative act with the power of law no. 9, dated 16.12.2019 of the Council of Ministers "On Coping with the Consequences of Natural Disasters".

At the end of the examination of this case, the Constitutional Court concluded that the required number of votes for decision-making was not reached, according to Article 73, Point 4, of Law no. 8577, dated 10.02.2000 "On the organization and functioning of the Constitutional Court of the Republic of Albania", amended, in relation to the legitimization ratione temporis of the petitioner for the initiation of this constitutional judgment in terms of the moment from which it begins to be calculated the 2-year deadline for submitting the request, provided by Article 50, point 1, of this same law, that is, if it is calculated from the time of entry into force of the normative act with the force of the law or the law approving it.

For these reasons, the Constitutional Court DECIDED: - Dismissal of the request.

The final decision will be announced as reasoned within the legal deadlines provided by law no. 8577, dated 10.02.2000 "On the organization and functioning of the Constitutional Court of the Republic of Albania", as amended by the Regulation on Judicial Procedures of the Constitutional Court.
