Throughout 2023, in addition to the daily functional activity of inspection, verification, investigation and disciplinary proceedings, the Office of the High Inspector of Justice in its work has paid special attention to the relationship with the citizen, in two dimensions: as a complainant for disciplinary violations of claims against judges and prosecutors and as an informed citizen, through legal education activities throughout the year with different social groups.
Complaining citizens have served as initiators of several different thematic inspections of the ILD Office during the year 2023. Such is the thematic inspection on the procedure of announcing and justifying court decisions, initiated by the examination of a large number of complaints on claims for the delay of the trial and the delays in clarifying the decisions by the judges. This inspection that was carried out in the Court of First Instance of the General Jurisdiction of Tirana (Civil Chamber) and the Administrative Court of First Instance of Tirana has been completed.
Equally, the dynamics of citizens' complaints has served to initiate thematic inspections on the assignment of cases to the prosecutor's office; on the division of cases by lot and the control of the reports of the electronic system in the courts; as well as on the practice and causes of replacement of prosecutors, thematic inspections that are in process and at different procedural stages.
Another thematic inspection, which is nearing completion, that of parole, has been initiated since the start of work of the ILD, in 2020, due to the high public sensitivity in that period after the releases of several well-known figures for justice.
Since the launch of the operation of the High Inspector of Justice, the attention to citizen-complainants has been high, both for those who have addressed directly to the ILD, but also for others, who had filed their complaints in the institutions for years predecessors, in charge of the disciplinary process of magistrates.
Thus, out of 33 requests for disciplinary proceedings submitted since 2020 by the High Inspector of Justice to the High Judicial Council and the High Prosecution Council, 28 of them are based on complaints filed by citizens with the ILD or with previous institutions , but inherited from the ILD, and investigated by it. Citizen engagement has been high. Only during the month of December 2023, 100 complaints were filed by citizens in the Office of the High Inspector of Justice, of which 40 complaints were filed only in the last week of December.
Bearing in mind the principle that an informed citizen manages to address the problem he encounters where appropriate, the Office of the High Inspector of Justice is following a public communication strategy, which starts in the institution, with the facilities created for every complainant, through the website, where there is a dedicated form to be filled out, and further, every day, with the reception and assistance of citizens who want to file a complaint physically or receive information about the progress of their complaint.
During 2023, the Complaints and Public Relations Office received 237 citizens; made 188 clarifying phone calls with interested citizens and answered 202 submitted requests for information.
At the same time, communication has continued outside the institution, as a function of transparency and public awareness on the mission, competences and responsibilities of the ILD Office, through legal education. For this, the High Inspector of Justice has created a tradition of conversations with different social groups, which has been intensified during 2023.
In 12 meetings and conferences, memoranda of cooperation, various social categories have been included, from pupils, students to Civil Society Organizations, focused on the justice system and the protection of human rights.
A mock trial by the students of the 9-year-old school "Besëlidhja e Malësë", in the city of Bajram Curri, open lectures with law students of the University of Vlora and Elbasan, accompanied by the signing of memorandums of cooperation, a conversation with the students of the Academy. Citizen in charge" in Tirana, have been targeted activities for the promotion of legal education, from the pre-university system to the university system.
In order to communicate with interest groups in the districts as well, the High Inspector of Justice has developed, during 2023, two discussion tables with Civil Society Organizations in Lezhë and Lushnja, with the support of the OSCE. The open communication at these tables highlighted the importance of the institution's presentation to the various interest groups, where they live and the discussions on how they see the institution's role, experiences and expectations in relation to the behavior of magistrates in the system.
This direct communication of the High Inspector of Justice serves to increase the transparency, but also the efficiency of the work of the ILD, also helping to increase and strengthen public trust in the justice system.
During the year 2023, the Office of the High Inspector of Justice has been the subject of professional study analyzes by Civil Society Organizations, which focus on the monitoring of the justice system. The Institute for Political and Legal Studies, the Center for the Study of Democracy and Governance and Infocip, through special events, have presented and discussed together with the High Inspector of Justice, with professionals in the field and representatives of institutions, the progress of the activity of the ILD, the challenges and progress, as well as the vision for the future.
In this year-end balance sheet, the Office of the High Inspector of Justice takes the opportunity to gratefully thank all the social groups, individual citizens and institutions that interacted with the ILD throughout 2023, for the evaluations, criticisms and suggestions to contribute in strengthening the institution, but also trust in the justice system, through the cultivation of law, as a social value, through legal education with the principles of the rule of law.
