Lawyer Plarent Ndreca: Not even Ols Dado himself said he was appointed legally;

Erion Veliaj's lawyer, Plarent Ndreca, stressed that the Administrative Court's decision on the mayor's lawsuit against the prosecutor who investigated him, Ols Dado, was expected. Ndreca stated that the public is very clear that Mr. Dado was not legally appointed, and not even Dado himself has disputed this fact.

Ndreca emphasized that at no point during this entire process did Mr. Dado say that I am a legally appointed prosecutor.

In a statement to the media after the decision, Ndreca stressed that with this decision, the justice system has once again shown that it has no ability to correct itself. He also warned that the case will be referred to the Appeals Court immediately after the court issues the reasoned decision.

" The way the process was conducted and how the process was prolonged for a procedural element, which I believe is in the eyes of the public and in your eyes very clear that it had to be accepted. The only way to escape from the fundamental examination of the truth was to disenfranchise. In other words, not allowing you to speak and express your arguments before the Court. So, not allowing you to have real access to the court. Of course, this was more than just accepting a lawsuit, it was a test for the system and in this case of the Administrative Court as to how much it has the ability to self-correct the problems that the system has and one of the major problems that the system has.

You are very clear, the public is very clear that Mr. Dado was not appointed legally. Mr. Dado himself has not disputed this fact. At no point during this entire process has Mr. Dado said that I am a prosecutor appointed legally. So, even in this case, the system has not shown, it has not shown the ability to self-correct; it has not shown the ability to examine the problems that the system itself has and I think that there is no more serious problem than the appointment of a prosecutor who today exercises a function without legal attributes, in a completely illegal manner, with absolutely illegal acts.

Of course, this is a first step. As I said in the session, in two previous sessions, this is already a truth that is not covered by any kind of procedural decision, it is a truth that we will pursue until the end, a truth that is not only related to me, Mr. Veliaj, it is not only related to the Municipality of Tirana, it is not only related to the consequences that such a decision is causing to all the citizens of Tirana, the entire Municipality as an institution, but it is related to the justice system itself and to the ability and capacity of the justice system not only to control other subjects but also to control itself, and in this case it has failed.

This decision is an indicator of the failure of the justice system itself to correct itself. I also said it in the court session. We have carried out a justice reform that is related to the principle of equality before the law. There can be no equality before the law, excluding prosecutors and judges. Equality before the law also works for prosecutors and judges. In this case, the judicial corporatism was shown, which excludes prosecutors and judges, i.e. members of the system, from equality before the law.

"Of course, we will immediately go to the Appeals Office, once we have the court's decision, we will follow this to the end and I think that no matter how late it is, we will certainly win this case because it is a fact that there is no one in Albania who does not know that this is how we say it is ," declared Ndreca.
