Elton Qynos' lawyer: The court recognized his writings as an expression of
Elton John

In a mini-interview for Hashtag.al, Dorian Matlija, the lawyer for journalist Elton Qyno, stated that the court's lifting of the mandatory appearance measure is an important decision regarding the journalist's prestige.

From his comments on the hearing, lawyer Matlija revealed that the court has qualified Qyno's writings as reporting the truth, regardless of who may have been directly or indirectly interested in these publications.

Interview:

How do you evaluate the Court of Appeal's decision to overturn the security measure against journalist Elton Qyno?

The decision of the Court of Appeals is an important step in guaranteeing press freedom and protecting journalists who cover sensitive issues such as organized crime. The security measure was found to be completely inappropriate for journalist Elton Qyno. On the surface, that measure seems very easy and specifically for journalist Qyno it was not at all a problem to appear at SPAK once a month when he appears there every day to report on organized crime issues. However, this measure created a discrediting effect on him, and indirectly gave a message to other journalist colleagues.

According to the court, the articles did not result in any content suspected of being false, and as long as they may be articles that reflect the truth, the journalist has a duty to publish them, regardless of who else they may be of interest to other than the general public.

The Special Prosecution claimed that the journalist had deleted articles, but the evidence showed otherwise, that the articles were still online. The Prosecution also raised the claim that the journalist was communicating with the suspected leader of a gang, but this proved to be incorrect in the courtroom, referring to the file, which the Prosecution itself served on the Court.

In short, for Elton Quinn, the prosecution is completely unclear about his role as a journalist and the accusation articulated so far is extremely weak and therefore there is absolutely no room for investigations under security measures of any kind.

2. What impact does this issue have on journalism in Albania?

Reporting on organized crime is difficult and dangerous, but also necessary because only through free and unintimidated journalism can the public be informed about developments in the criminal underworld. The repeal of this measure today is a message of reassurance to the entire community of journalists, who need to work protected from the interference of any authority, including that of the judiciary.

3.What is expected to happen next?

Of course, further investigations are expected to be conducted in the future and the position of the journalist in relation to the other persons involved in the investigation is to be clarified. Of course, I also expect reflection from the Special Prosecutor's Office to first understand how this type of journalism works, and, secondly, to use correct investigation methods, avoiding violating the relevant standards. Let's not forget that journalist Elton Qyno's phones are still under seizure, while the Supreme Court has already ordered their return because they were kept for an unreasonable time, and the Constitutional Court is also expected to express its opinion on the violation of standards that also caused the unprecedented reaction of the UN Human Rights Committee.

The Special Prosecution Office must learn to accurately identify where that thin line crosses where crime as a phenomenon meets journalism as a close observer.
