At the end of three years of the reduction of 38 courts to 20, Minister of Justice Toni Gogu tells TCH that the new judicial map will continue, the efficiency of which is being evaluated through legal interventions led by the High Judicial Council.
"We cannot talk about failure because it would be dishonest about the work that has been done and it would be dishonest about the results that have been achieved. Of course, some problems have been created and you mentioned some elephants in the room, the issues that have been carried over and the access that we can say has been limited, the system was somewhat fragmented and how it could be regulated better. The system was fragmented and needed to be regulated also for the vacancies created by vetting. In this sense, we are already in the phase to look at new tools, because we must say one thing bluntly, citizens must receive justice in the same way as they receive other public services. They cannot travel longer, they cannot wait longer, I believe the system itself will propose and has set up a work plan to address the delays ," said Gogu.
The solution being discussed is the engagement of a single judge who, during urgent hearings, is supported by judicial services in closed courts.
"The first thing we need to understand is the causal map of the creation of delays, I believe it is not, it is the vacancies, or should a judge who judges as a single person be returned using the administration and the judicial service ," he said.
In his first interview as Minister of Justice, Gogu spoke about the criminal code, which another former Minister of Justice has promised will be ready by the end of 2026.
"It is not our goal to have a penal code within a certain time frame, our goal is to have a code, but is it penal within a certain time frame, but that reflects our social reality and protects our social contract, protects the citizen and stands the test of time."
When did he start meeting with justice stakeholders, most recently with the chief prosecutor of SPAK, Klodian Braho, and is he or not in favor of the special prosecutors' request for an extension of their mandate?
"This is an issue that requires maximum attention, what I can tell you is the motto of our socialist majority at the top of the agenda. So there is no equivocation that we will guarantee the independence of justice institutions and having said that, the status of SPAK prosecutors is one of those issues of constitutional annexes that have guaranteed this, so they deserve a study, an extremely careful inter-institutional dialogue", said Gogu./ TCH
