Media violate European Convention when interviewing minors without parents'

Journalists and the media violate the right of privacy and family right when interviewing minors without the presence and consent of their parents.

This is the decision of the European Court of Human Rights, which was set in motion after the deposition of a Romanian family. Their minor son was part of an excursion in 2012, where tragically one of the students died.

The incident attracted media attention and one of them interviewed minors without the presence of teachers, without the presence of parents and without the approval of any of them. The interview aired within that day.

The parents sued the local courts on the television channel seeking reparation because they had not given their approval over an interview their child had given. Local courts overruled this claim, stating that the case concerned the public interest, and the journalist enjoyed the freedom of the media to publish the news and notify the public.

The romanian courts' decision was appealed in Strasbourg. This court on the one hand weighed the right to respect private and family life and on the other hand public interest and the right to information.

After analyzing all the evidence presented by the parties, Strasbourg gave the former the right, deciding that it prevails over the public interest in the cases of minors, whose interview cannot be carried out without the presence and authorisation of their parents.

According to the European Court of Human Rights, article 8 of the European Convention on Human Rights concerning private and family law was violated in this case and imposed fines on the television channel and the compensation of the Romanian family affected by this episode.
