Former Chief Prosecutor Adriatik Llalla, who is on the run, is seeking to escape prison with a procedural action.

Sentenced to 2 years in prison, Llalla requests the GJKKO to revoke the sentence, which means the sentence will be expunged.

He was sentenced in 2021 to 2 years in prison for concealing assets.

The decision was not executed, as Llalla fled the country, where he has been hiding for 5 years.

What is the statute of limitations?

The statute of limitations is a legal institution that means that, after a period of time specified by law has passed, the state may lose the right to execute a criminal sentence imposed by the court.

In simple terms: a person may have been sentenced by a court decision, but if the legal statute of limitations passes without the sentence being executed, it may no longer be possible to enforce that sentence.

According to Article 68 of the Criminal Code, the statute of limitations for the execution of a sentence are:

Up to 5 years in prison, 5 years

Over 5 to 15 years imprisonment, 10 years

Over 15 to 25 years imprisonment, 20 years

The deadline is calculated from the day the sentence becomes final.
